Argumentum ad imperfectionem

The argumentum ad imperfectionem is a kind of fallacious argument advanced by lazy meta commentators.  It consists in alleging that the imperfections in the arguments of certain peripheral exponents of a particular view justify the weak-manning of the opponents of those views.   

So for instance, some less than responsible or scientifically accurate characterizations of the family of views known as climate change justify the wildly erroneous allegations of global warming deniers.  Here's an example from the Washington Post's Dana Milbank:

As a scientific proposition, claiming that heavy snow in the mid-Atlantic debunks global warming theory is about as valid as claiming that the existence of John Edwards debunks the theory of evolution. In fact, warming theory suggests that you'd see trends toward heavier snows, because warmer air carries more moisture. This latest snowfall, though, is more likely the result of a strong El Niño cycle that has parked the jet stream right over the mid-Atlantic states.

Still, there's some rough justice in the conservatives' cheap shots. In Washington's blizzards, the greens were hoist by their own petard.

For years, climate-change activists have argued by anecdote to make their case. Gore, in his famous slide shows, ties human-caused global warming to increasing hurricanes, tornadoes, floods, drought and the spread of mosquitoes, pine beetles and disease. It's not that Gore is wrong about these things. The problem is that his storm stories have conditioned people to expect an endless worldwide heat wave, when in fact the changes so far are subtle. 

Other environmentalists have undermined the cause with claims bordering on the outlandish; they've blamed global warming for shrinking sheep in Scotland, more shark and cougar attacks, genetic changes in squirrels, an increase in kidney stones and even the crash of Air France Flight 447. When climate activists make the dubious claim, as a Canadian environmental group did, that global warming is to blame for the lack of snow at the Winter Olympics in Vancouver, then they invite similarly specious conclusions about Washington's snow — such as the Virginia GOP ad urging people to call two Democratic congressmen "and tell them how much global warming you get this weekend."

That's just nuts.  Gore and the climate change activists are correct (Milbank doesn't doubt that), but examples used in their arguments may give lazy or just plain dishonest people the wrong idea.  It's their fault, in other words, that they have used anecdotes to illustrate claims about the consequences of a warming atmosphere.  Giving examples, anecdotes in other words, is one way a view can be communicated.  These anecdotes, by the way, are not perfect.  They are not perfect especially in the hands of people with no particular scientific training or real grip of the view they hold.  A view, in this circumstance, which turns out to have a sound justification. 

Misrepresenting the scale or significance of the imperfect anecdote in order to undermine the view is what we call "weak manning," that is, distorting a view by selection of its weakest justifications.  There likely are lots of these.  But this does not justify the dishonesty of people who know of better arguments.  And the existence of weak exponents of a particular view does not entail that the view itself is weakened.

They’re just nihilists

The Washington Post has given tenured spots on its page to a serial climate change denier (George Will), a conspiracy theorist (Charles Krauthammer), and they have offered up guest spots to the likes of Sarah Palin and other alleged global warming skeptics.  Today, finally, a little bit of balance.  Eugene Robinson goes after Palin's latest op-ed, and Anne Applebaum reaffirms the obvious and well-known facts about global warming. However, as if a part of some weird conspiracy to exacerbate the problem of the doubters, their arguments blow. 

Robinson's entire piece is directed at the alleged change in Palin's position.  As governor of Alaska, Robinson points out, Palin seemed to affirm the reality of climate change, but now she denies it.  But that's not what Robinson says:

In her administrative order, Palin instructed the sub-Cabinet group to develop recommendations on "the opportunities to reduce greenhouse gas emissions from Alaska sources, including the expanded use of alternative fuels, energy conservation, energy efficiency, renewable energy, land use management, and transportation planning." She also instructed the group to look into "carbon-trading markets."

But in her op-ed last week, Palin — while acknowledging "natural, cyclical environmental trends" and the possibility that human activity might be contributing to warming — states flatly that "any potential benefits of proposed emissions reduction policies are far outweighed by their economic costs." What she once called "carbon-trading markets" she now denounces as "the Democrats' cap-and-tax proposal."

Is there nobody at the Post who can point out that this is not a contradiction.  She instructed a group to "look into" not to "endorse" carbon trade proposals.  She's clearly unhappy with the ones offered.  Robinson is so gleeful in the discovery of his alleged contradiction that he doesn't realize he hasn't found it.  Besides, what does it matter?  She can change her mind if she wants.  Further, who cares what she thinks?  She is neither a scientist nor an elected official of any consequence. 

By contrast, Anne Applebaum has found the real culprit in the whole climate change debate: scattered crazy enivronmentalists.  And she goes in the for the full weak man.  She begins, ominously enough:

There is no nihilism like the nihilism of a 9-year-old. "Why should I bother," one of them recently demanded of me, when he was presented with the usual arguments in favor of doing homework: "By the time I'm grown up, the polar ice caps will have melted and everyone will have drowned."

When I was a kid it was nuclear war.  Anyway, what lesson does she draw from this.  No, not that for many kids this will be a reality.  Rather, people who point this out are a big bringdown:

Watching the news from Copenhagen last weekend, it wasn't hard to understand where he got that idea. Among the tens of thousands demonstrating outside the climate change summit, some were carrying giant clocks set at 10 minutes to midnight, indicating the imminent end of the world. Elsewhere, others staged a "resuscitation" of planet Earth, symbolically represented by a large collapsing balloon. Near the conference center, an installation of skeletons standing knee-deep in water made a similar point, as did numerous melting ice sculptures and a melodramatic "die-in" staged by protesters wearing white, ghost-like jumpsuits.

Danish police arrested about a thousand people on Saturday for smashing windows and burning cars, and on Sunday arrested 200 more (they were carrying gas masks and seem to have been planning to shut down the city harbor). Nevertheless, in the long run it is those peaceful demonstrators, the ones who say the end is nigh, who have the capacity to do the most psychological damage.

The second group of people have nothing to do with negative messaging.  She goes on and on with examples of nutty environmentalists who just make you feel bad with all of their blaming and hyperbole (the veracity of which she doesn't question).  All of this, however, is a silly distraction.  The law of probability has it that global warming will attract no small number of people who say crazy things (if in fact they're guilty of that).  Can you really blame them, however, when you have well-paid people on the staff of the Post–not sign-carrying nutters in the streets–who deny well-established facts. 

Who is the real nihilist?  The one who says we're doomed if we do nothing?  Or the one who alleges it's all a big communist lie?  

 

My distortions are your fault

There was a time when a young Robert Samuelson insisted that cost should not count if something like an invasion of Iraq was necessary. He wrote:

A possible war with Iraq raises many unknowns, but “can we afford it?” is not one of them. People inevitably ask that question, forgetting that the United States has become so wealthy it can wage war almost with pocket change. A war with Iraq would probably cost less than 1 percent of national income (gross domestic product). Americans have grown accustomed to fighting with little economic upset and sacrifice.

He regretted writing that. Having spent something like a lot of money now on Iraq, one might reasonably ask whether Samuelson should be listened to on matters of cost. I would say not. In any case, so Samuelson makes his argument against health care reform by the well-known device of attacking someone’s motives:

The campaign to pass Obama’s health-care plan has assumed a false, though understandable, cloak of moral superiority. It’s understandable because almost everyone thinks that people in need of essential medical care should get it; ideally, everyone would have health insurance. The pursuit of these worthy goals can easily be projected as a high-minded exercise for the public good.

It’s false for two reasons. First, the country has other goals — including preventing financial crises and minimizing the crushing effects of high deficits or taxes on the economy and younger Americans — that “health-care reform” would jeopardize. And second, the benefits of “reform” are exaggerated. Sure, many Americans would feel less fearful about losing insurance; but there are cheaper ways to limit insecurity. Meanwhile, improvements in health for today’s uninsured would be modest. They already receive substantial medical care. Insurance would help some individuals enormously, but studies find that, on average, gains are moderate. Despite using more health services, people don’t automatically become healthier.

Let me state first that Samuelson isn’t talking here about the specific plan (he does later, but he relies on the Lewin group, an insurance company funded “research” group–so, really, please), he’s talking about the general concept of reform. For anyone with a minimal knowledge of other industrialized nations, who spend at most about half of what he do and get a lot more, this is just an insult. For more on that, see here.

But more basically, Samuelson is doing a bit of straw man–weak man actually–and a bit of ad hominem circumstantial. It’s a weak man because he picks on the weakest of the pro-health reform moral arguments. There are other good moral reasons to support health care reform, and they involve arguments against the very real threat of medical bankruptcy, recision, denial of coverage of pre-existing conditions, and so forth.

The ad hominem accompanies the weak man–so weak are these arguments (which Samuelson has imputed to pro-reform people), that they must rather be dishonest attempts to score political points. Now that’s just a double-wammy. It’s a bit like saying this: “the weak argument I have dishonestly imputed to you is so bad that I question your honesty in making it.”

On the arguments against the specific plan, I’d say Samuelson needs to look beyond anti-reform sources of analysis and information. It’s a fair question whether the current plans being discussed will help, so we ought to have an honest discussion of that. But that perhaps is just hoping for too much.

But let me close by going back to something Samuelson said in defense of his poorly thought-out defense of the Iraq invasion:

But I am certain — now as then — that budget consequences should occupy a minor spot in our debates. It’s not that the costs are unimportant; it’s simply that they’re overshadowed by other considerations that are so much more important. We can pay for whatever’s necessary. If we decide to do less because that’s the most sensible policy, we shouldn’t delude ourselves that any “savings” will rescue us from our long-term budget predicament, which involves the huge costs of federal retirement programs. Just because the war is unpopular doesn’t mean it’s the source of all our problems.

Other considerations that are much more important. Indeed.

Profits good

I'm sure Stephen L. Carter is a smart guy, but his opinion piece in the Washington Post today is unquestionably silly.  Here's how it begins:

A specter is haunting America: the specter of profit. We have become fearful that somewhere, somehow, an evil corporation has found a way to make lots of money.

Ok–who can see the problem?  Is it profits simpliciter (I used the Latin phrase since we're talking about a Yale law professor's thoughts here)?  High profits?  Or, perhaps, are we talking about disproportionately high profits earned when people don't make disproportionately large amounts of money?  I'm confused.  But let's continue.

Flash back three years. In 2006, Exxon Mobil announced the highest profit in the history of American corporate enterprise. Politicians and pundits stumbled over each other to call for an investigation and for some sort of confiscatory tax on the money the company earned. Profit, it seemed, was an evil, but large profit was even worse.

Again, I wonder, was it the simple fact of their making a profit, or was it there making a certain kind of profit.  Those, I think, are different propositions.  And indeed, when one considers the amount of public treasure (US military) spent on making Exxon's private wealth secure, one wonders whether it's fair for Exxon to reap rewards incommensurate with their contribution to the res publica, the public thing (Latin again).

Today, the debate on the overhaul of the health-care system sparks a shiver of deja vu. The leitmotif of the conversation about the coming shape of health insurance is that the villain is the system of private insurance. "For-profit" firms come under constant attack from activists and members of Congress.

Thus, a recent news release from the AFL-CIO began with this evidently alarming fact: "Profits at 10 of the country's largest publicly traded health insurance companies rose 428 percent from 2000 to 2007." Even had the figures been correct — they weren't — we are seeing the same circus. Profit is the enemy. America could be made pure, if only profit could be purged.

This attitude was wrong in 2006. It is wrong now. High profits are excellent news. When corporate earnings reach record levels, we should be celebrating. The only way a firm can make money is to sell people what they want at a price they are willing to pay. If a firm makes lots of money, lots of people are getting what they want.

Again–profits, high profits, disproportionate profits, and now profits illegitimately gained.  The problem with the high profits of the insurance companies is that they depend on their not paying claims–on their denying people the insurance that they have paid for (or charging a lot for very little).  Further, it's wrong to talk of "price their willing to pay" when it comes to insurance–one typically has little to no choice in the amount one has to pay or to whom one pays it.

This argument is already so bad that it's not worth continuing to criticize it–the rest goes on to argue that profit is good (including price gouging during natural disasters!).  But no one, save for a few college socialists (and really not even them) denies that profit simpliciter is a positive thing.  They just hold that profits of certain types and quantities are not necessarily a good thing–case in point, health insurance.  The confusion at the beginning makes this argument a case of equivocation, but the fact that the argument sets up a non-existent opponent makes it a very nice case of a hollow man (with a bit of weak man and classic straw man).  In other words, awesome take down, professor Carter, of an argument no one has seriously made.

A statement like this should not be taken out of context

Michael Gerson worries about taking Justice Ruth Bader Ginsburg out of context, merely in order to take her out of context.  Here's what he says:

There was a scandal this week concerning the Supreme Court, though it didn't concern the nomination of its newest member.

The New York Times Magazine printed a candid interview with Justice Ruth Bader Ginsburg, including this portion:

Q: "Are you talking about the distances women have to travel because in parts of the country, abortion is essentially unavailable, because there are so few doctors and clinics that do the procedure? And also, the lack of Medicaid abortions for poor women?"

Clearly that question refers to some amount of previous discussion, so Gerson writes:

Justice Ginsburg: "Yes, the ruling about that surprised me. [Harris v. McRae — in 1980 the court upheld the Hyde Amendment, which forbids the use of Medicaid for abortions.] Frankly I had thought that at the time Roe was decided, there was concern about population growth and particularly growth in populations that we don't want to have too many of. So that Roe was going to be then set up for Medicaid funding for abortion."

A statement like this should not be taken out of context. The context surrounding this passage is a simplistic, pro-choice rant. Abortion, in Ginsburg's view, is an essential part of sexual equality, thus ending all ethical debate. "There will never be a woman of means without choice anymore. That just seems to be so obvious," she explains. "So we have a policy that affects only poor women, and it can never be otherwise, and I don't know why this hasn't been said more often." Of pro-lifers, she declares, "They're fighting a losing battle" — which must come as discouraging news to litigants in future abortion cases that come before the high court.

Given this context, can it be argued that Ginsburg — referring to "populations that we don't want to have too many of" — was merely summarizing the views of others and describing the attitudes of the country when Roe v. Wade was decided? It can be argued — but it is not bloody likely. Who, in Ginsburg's statement, is the "we"? And who, in 1973, was arguing for the eugenic purposes of abortion?

No, it's obvious from the actual context (which is actually linked in the online version of this article) that this is what Ginsburg is talking about.  Here is what she says.  

Q: Let me ask you about the fight you waged for the courts to understand that pregnancy discrimination is a form of sex discrimination.

JUSTICE GINSBURG: I wrote about it a number of times. I litigated Captain Struck’s case about reproductive choice. [In 1972, Ginsburg represented Capt. Susan Struck, who became pregnant during her service in the Air Force. At the time, the Air Force automatically discharged any woman who became pregnant and told Captain Struck that she should have an abortion if she wanted to keep her job. The government changed the regulation before the Supreme Court could decide the case.] If the court could have seen Susan Struck’s case — this was the U.S. government, a U.S. Air Force post, offering abortions, in 1971, two years before Roe.

Q: And suggesting an abortion as the solution to Struck’s problem.

JUSTICE GINSBURG: Yes. Not only that, but it was available to her on the base.

Q: The case ties together themes of women’s equality and reproductive freedom. The court split those themes apart in Roe v. Wade. Do you see, as part of a future feminist legal wish list, repositioning Roe so that the right to abortion is rooted in the constitutional promise of sex equality?

JUSTICE GINSBURG: Oh, yes. I think it will be.

Q: If you were a lawyer again, what would you want to accomplish as a future feminist legal agenda?

JUSTICE GINSBURG: Reproductive choice has to be straightened out. There will never be a woman of means without choice anymore. That just seems to me so obvious. The states that had changed their abortion laws before Roe [to make abortion legal] are not going to change back. So we have a policy that affects only poor women, and it can never be otherwise, and I don’t know why this hasn’t been said more often.

Q: Are you talking about the distances women have to travel because in parts of the country, abortion is essentially unavailable, because there are so few doctors and clinics that do the procedure? And also, the lack of Medicaid for abortions for poor women?

It's clear that Ginsburg is not talking about her own personal position, as Gerson suggests, but rather the position of public opinion and the court at that time.  She even admits that her perception of that was wrong, not her personal view. 

Her argument, as is obvious, is that abortion law (as it stands) discriminates against women who cannot afford it.  And she makes the observation, not the assertion of an ethical absolute as Gerson dishonestly suggests, that rich women will always have the choice, since they have the means to travel or to afford that choice.  

Gerson's dishonest version of Ginsburg's interview isn't even close–perhaps the sign of that is the odd formulation: a statement like this should not be taken out of context.  I wonder, which statements should be taken out of context?

Safire on straw men

William Safire was one of the inspirations for this site.  No, not for his semi-erudite columns on language, but rather for the consistent sloppiness of his arguments in his op-ed columns.  He retired from op-ed writing shortly after we started this blog (almost five years ago!), so that was it for him, for us.  But he never stopped writing (so far as I can gather, I don't read it that often) his On Language column for the Sunday Magazine.

Recently he has been a go-to guy on the notion of a straw man, as if his supposed expertise on matters of language makes him a master of critical reasoning.  It obviously doesn't, as the following passage from last week's column will demonstrate:

Accepting the Democratic nomination in a huge football stadium way back in the presidential campaign of ’08, Senator Barack Obama displayed his oratorical talent by using one of his favorite tried-and-true devices in argument: “Don’t tell me that Democrats won’t defend this country!”

Who was telling him that? To be sure, his opponents were claiming that a Republican administration would be stronger on defense, but nobody was telling him or the voters that Democrats preferred abject surrender. At the time, reviewing that speech, I noted the rhetorical technique: “By escalating criticism, he knocked down a straw man, the oldest speechifying trick in the book.”

Encouraged by his reviews for eloquence, President Obama has embraced the straw man frequently (as F.D.R. liked to emphasize it, “again and again and again”) with nary a peep of criticism. Two weeks ago, the Times correspondent Helene Cooper dared to note this president’s repeated use of digs like “I know some folks in Washington and on Wall Street are saying we should just focus on their problems.” Some folks, like those who, are never named but are always wrongheaded extremists. Her “White House Memo” was headlined “Some Obama Enemies Are Made Totally of Straw”; its subhead was “Setting them up to have someone to knock down.” Cooper, as the objective reporter, gave examples of conservative politicians who speak straw-manese, although none with such fluency.

I suppose Safire doesn't read the newspaper, listen to speeches, or know how to use google.  A constant theme of Republican arguments in the last two National election cylces has been that the Democrats would not defend this country (see any speech by Dick Cheney–chances are "we'll get hit again").  On top of this, Safire even straw-mans the alleged Obama straw man: Obama said "would not defend" and Safire says "preferred abject surrender."  Those are different.

More basically, Safire doesn't really get what makes a straw man a straw man.  Just because one uses "those who" or "some" does not mean one is using a straw man.  What makes an argument a straw man is the distortion or actual arguments, the selection of really weak and unrepresentative arguments (the weak man), or the whole-cloth invention of silly arguments and non-existent arguers (the hollow man) for the sole purpose of defeating them.  "Some" and "those who" may be a sign of a straw man, but it's not a sufficient condition for one.

The average person must think

Richard Cohen, liberal columnist for the Washington Post, has struggled with some very basic logical notions.  Today is no exception.  Today again he puts on his contrarian hat and accuses a lot of unnamed people–admirers of Sonia Sotomayor (Obama's nominee for the Supreme Court) of elitism and racism.  He writes:

With the nose of a trained columnist, I detect the whiff of elitism-cum-racism emanating from the nomination of Sonia Sotomayor to the Supreme Court. The whiff does not come — Rush Limbaugh and Newt Gingrich notwithstanding — from Sotomayor's own statements; nor does it come from her controversial decision upholding race-based affirmative action. It comes, instead, from the general expression of wow about her background. Imagine, someone from the projects is a success!

"Nobody expects you to be chosen someday for the Supreme Court when your father was a welder with a third-grade education," wrote Richard Lacayo in Time magazine. He is right — the expectations are all otherwise. You can see them on display in many of the reports about Sotomayor's background. She was raised in public housing projects. She grew up in the Bronx, which the average person must think of as a particularly nasty part of Mumbai, and she is, finally and incriminatingly, Puerto Rican. This is all, apparently, very hard to imagine.

With the nose of a trained nonsequitarian, I detect a whiff of it-does-not-follow here.  Cohen's only evidence of a "general expression of wow" is some guy writing in Time and his own "the average person must think."  He then goes on to debunk this not-established-to-exist general expression by running through a list of unnusually successful (and therefore completely unrepresentative) people (for any background) who come from public housing projects (Mike Tyson, Jay-Z, Ken Auletta, etc.).  No one can plausibly deny the empirical possibility of being a success in any endeavor despite having been born in the projects.  But what wows people are the probabilities.  As Cohen ought to know, the expectations for people in the projects are indeed very different, not out of racisim, but out of a realistic sense of how one is successful in America.  I doubt it is really elitism to think that.

More on straw men

A commenter points to this February Wall Street Journal piece by Karl Rove on straw men.  I know.  The very idea of that person criticizing anyone for slimy rhetorical devices is beyond ridiculous.  But in the interest of fairness, let's discuss it anyway.

I should say first of all (I should repeat actually) that it's not much of an achievement to find "straw men" in anyone's "political advocacy" discourse.  There is after all a rather significant difference between a pundit, writing in the calm, reflective light of reason, and a politician, advocating for this or that policy or action.  While pundits represent ideological points of view, they do so on the assumption (I believe, at least) that the best arguments have compelled them.  Politicians must be content, however, to achieve their policy objectives by moving people to action.  This motivational discourse involves different rules.  A politician, I think, of any variety, can be allowed to paint in broad strokes, especially when it comes to his opposition, without suffering the accusation of using a straw man.  

This genre confusion, I think, is what drives Rove's inane piece.  He confuses the broad strokes of a politician, in particular the use of "some," for straw man arguments.  "Some" may signal a straw man, but it need not.  Rove writes:

President Barack Obama reveres Abraham Lincoln. But among the glaring differences between the two men is that Lincoln offered careful, rigorous, sustained arguments to advance his aims and, when disagreeing with political opponents, rarely relied on the lazy rhetorical device of "straw men." Mr. Obama, on the other hand, routinely ascribes to others views they don't espouse and says opposition to his policies is grounded in views no one really advocates.

On Tuesday night, Mr. Obama told Congress and the nation, "I reject the view that . . . says government has no role in laying the foundation for our common prosperity." Who exactly has that view? Certainly not congressional Republicans, who believe that through reasonable tax cuts, fiscal restraint, and prudent monetary policies government contributes to prosperity.

Mr. Obama also said that America's economic difficulties resulted when "regulations were gutted for the sake of a quick profit at the expense of a healthy market." Who gutted which regulations?

Not naming one's rhetorical opponent in a political speech is not the same thing as a straw man.  And besides, these and the rest of Rove's examples are not straw men, in that there are people, Republican people, who make arguments that the government never ever created one single job, and so forth (see chairman of the GOP, Michael Steele).  Obama's not naming them does not entail he's making them up.

So, I would say, Obama (and Bush, etc.) deserve some leeway in the identification of their opponent, especially in the context of major political speeches.  Does this free them from the responsibility of fairly characterizing their opponents?  Obviously not.  The boundaries of fair play are just somewhat broader.

New York Times tries Critical Thinking 101 and then fails it

I was out of town for the weekend when Helene Cooper's abysmal analysis piece (On Obama's "straw men") appeared in the New York Times, so I'll pretty much just point everyone to discussions of it elsewhere.  It seems to have been largely written by Fred Barnes, a conservative columnist who has long been griping about Obama's alleged tendency to attack straw men.  Perhaps we ought to remember that the 2008 Presidential campaign pitted Obama against a set of candidates for whom the term "straw man" described their owns positions on most issues.  Nonetheless, Cooper writes:

WASHINGTON — Democrats often complained about President George W. Bush’s frequent use of a rhetorical device as old as rhetoric itself: creating the illusion of refuting an opponent’s argument by mischaracterizing it and then knocking down that mischaracterization.

There was much outrage in 2006, for example, when Mr. Bush said that when it came to battling terrorists, “I need members of Congress who understand that you can’t negotiate with these folks,” implying that Democrats backed talks with Al Qaeda. That assertion was promptly, and angrily, disputed by Senator John Kerry of Massachusetts.

Now that there is a new team at the White House, guess who is knocking down straw men left and right? To listen to President Obama, a veritable army of naysayers has invaded Washington, urging him to sit on his hands at the White House and do nothing to address any of the economic or national security problems facing the country.

There are those who say these plans are too ambitious, that we should be trying to do less, not more,” Mr. Obama told a town-hall-style meeting in Costa Mesa, Calif., on March 18. “Well, I say our challenges are too large to ignore.”

In order for an argument to be a straw man (speaking generally), it has to be (1) actually advanced as stated by no serious party in the current discussion and (2) a silly view no one would hold anyway (there are variations on this–the weak man and the hollow man).  As the following link will show, Cooper's article doesn't establish that either of the two requirements (and both are necessary, but not independently sufficient) have been met.  The press, for instance, spoke endlessly about whether Obama was "doing too much."  Two seconds of googling will give you tons of examples.  For more, see here.

When I say this stuff is not hard, I'm serious.  It's not.

White whine

White men can't catch a break these days.  First, the white guy lost the Presidential election, now the winner gets to appoint someone to the Supreme Court.  Though Obama has so far said nothing, this hasn't stopped speculation of the weirdest variety:

 

That's a stock image of an average white guy in a tie (from istockphoto.com), not, as one might have imagined, some shunned potential Supreme Court nominee.  Now Richard Cohen–liberal columnist in the Washington Post–expresses his deep concern over the fate of white men under the impossible burden of affirmative action.  He writes:

As the time approaches for President Obama to choose a successor to Justice David Souter, the term "litmus test" will be heard throughout the land. The White House will deny applying any such thing, but the nominee will undoubtedly be chosen according to where she stands on abortion, unions and other issues beloved by liberals. This is fine with me, but what I want to know is where she stands on Frank Ricci. He's a firefighter.  

What follows is a detailed description of Ricci's case (recently argued before the Supreme Court)–how he's been discriminated against on account of his being white, and so forth.  That may be, and by Cohen's very sorry description of the case, it looks absurd.  But as a general rule absurd arguments do not make it all the way to the Supreme Court, so one might wonder.  But that's not the point anyway.  Cohen seems to take this particularly absurd case as representative for how affirmative action needs to end, since, of course, racism is over and so forth (because "For most Americans, race has become supremely irrelevant. Everyone knows this. Every poll shows this.").

It's worse than this, however, because affirmative action (as demonstrated by Cohen's extreme example) is profoundly unfair in principle (like trying to "square a circle."):

Liberalism, a movement in which I hold a conditional membership, would be wise to get wise to what has happened. Blatant affirmative action always entailed a disturbing and ex post facto changing of the rules — oops, you're white. Sorry, not what we wanted. As a consequence, it was not racists who were punished but all whites. There is no need to cling to such a remedy anymore. There is, though, every need to retain and strengthen anti-discrimination laws, especially in areas such as fire departments, where racial discrimination was once endemic. Sufficient progress has been made to revert to treating individuals as individuals. After all, it is not some amorphous entity called "whites" who will suffer: It is un-lieutenant Ricci.

Bill Clinton tried to square the circle of affirmative action in his "Mend It, Don't End It" speech of 1995. It was a moving and eloquent address in which he recounted his region's history, reminding us of the depth and ferocity of racism in the South and elsewhere. Trouble is, the New Haven case proves that affirmative action was not mended at all. It remains noble in its ends and atrocious in its means, and it now provides Obama the chance to use his own family's history — indeed his own history — to show why it ought to conclude.

Affirmative action was never meant to "punish" racists by excluding them from employment.  This underscores Cohen's failure to grasp both the concept of affirmative and the facts of the case he discusses (his only reference is an op-ed in the Wall Street Journal by two conservative think-tankers).  One can found more background on the relevant legal questions here.  Without the necessary and obvious context, Cohen's ranting sounds a bit like this.
