You have a right to be wrong

True story.  A few years back one of my students had confused some minor matter about a text of Plato.  When I pointed that out, another student commented: "He has a right to be wrong."  That odd justification comes out in a George Will op-ed where he, unlike his usual, argues for new rights not enumerated in the constitution.  Now of course he probably thinks he can get there with a series of individually valid inferences.  Fine, but you have to understand that any other time one maintains a right not specifically enumerated in the Constitution, Will will shout "judicial activism" or some other synonym.  Don't get me wrong, I believe in the concept of inferential rights, I just think it's funny that Will doesn't, until he does.

This is not to say, however, that Will does not have a point.  He may, but I think, as is perhaps no surprise, that his argument for it sucks.  He maintains as a kind of premise one that liberals want to coerce others to believe like they do–this is their MO, which is a word the very pretentious Will would likely spell out: Modus operandi.  It's a little ironic, since the specific topic in question concerns the desire of some (not the liberals) to limit the rights of others to engage in private, self-regarding behavior.  Some people, not happy with the structure of our democracy (where fundamental rights get interpreted out of the Constitution sometimes), gather signatures to put such matters on the ballot.  This raises an important question: are signatures on referendums like voting and therefore private? 

I think it's fair to say that such a question admits of no easy answer.  But just because it doesn't admit of an easy answer, does not mean any answer, such as the following one offered by Will, will suffice:

The Supreme Court has held that disclosure requirements serve three government interests: They provide information about the flow of political money, they deter corruption and avoid the appearance thereof by revealing large contributions, and they facilitate enforcement of contribution limits. These pertain only to financial information in candidate elections. These cannot justify compelled disclosures regarding referendums because referendums raise no issues of officials' future performance in office — being corruptly responsive to financial contributors. The only relevant information about referendums is in the text of the propositions.

In 1973, Washington's secretary of state ruled that signing an initiative or referendum petition is "a form of voting" and that violating voters' privacy could have adverse "political ramifications" for those signing. In 2009, some advocates of disclosure plan to put signers' names on the Internet in order to force "uncomfortable" conversations.

In the interest of fairness, something I'm always interested in by the way, the above two paragraphs make some attempt at arguing for the position that referendum signatures ought to be private.  I think their attempt fails: The first is irrelevant to the particular issue and the second cites the irrelevant precedent of the secretary of state.  A referendum petition by any standard is not a vote: you sign your name and put your address on it for the purposes of public inspection of its authenticity.  You do not sign your vote. 

In any case, the following arguments for the above proposition really blow:

Larry Stickney, a social conservative and president of the Washington Values Alliance, says that disclosure of the identities of petitioners will enable "ideological background checks" that will have a chilling effect on political participation. He frequently encounters people who flinch from involvement with the referendum when they learn that disclosure of their involvement is possible. He has received abusive e-mails and late-night telephone calls and has seen a stranger on his front lawn taking pictures of his house.

The Wall Street Journal's John Fund reports that some Californians who gave financial support to last year's successful campaign for Proposition 8 — it declared marriage to be only between a man and a woman — subsequently suffered significant harm. For example, the director of the Los Angeles Film Festival, who contributed $1,500, was forced to resign. So was the manager of a fashionable Los Angeles restaurant who contributed just $100.

The first paragraph offers evidence that vociferous advocates may suffer the paranoia that comes along with taking an unpopular position on a matter of public interest.  It does not establish that a private citizen whose only action was signing a petition may suffer these things.  The second paragraph shows that people who have given financial support, something about which disclosure has been determined to be legitimate (and admitted to by Will himself only a three paragraphs before) have suffered harm.  I don't think one can be fired for one's political affiliations–there are laws against that I believe.

Charles Bouley, a gay columnist, has honorably protested such bullying. He says that people "have the right to be wrong," and reminds gay activists: "Even Barack Obama said marriage was between a man and a woman at a time when we needed his voice on our side on equality. He let us down, too, remember, and many of you still gave him a job."

Indeed, people do have a right to be wrong, and others have a duty to point that out.

It’s good to be a gangster

George Will defends the crazy:

After six years in the state Legislature, she ran for Congress and now, in her second term, has become such a burr under Democrats' saddles that recently the New York Times profiled her beneath a Page One headline: "GOP Has a Lightning Rod, and Her Name Is Not Palin." She is, however, a petite pistol that occasionally goes off half-cocked.

For example, appearing on MSNBC's "Hardball" 18 days before last year's election, she made the mistake of taking Chris Matthews's bait and speculating about whether Barack Obama and some other Democrats have "anti-American" views. In the ensuing uproar — fueled by people who were not comparably scandalized when George W. Bush was sulfurously vilified — her opponent raised nearly $2 million and her lead shrank from 13 points to her winning margin of three.

Well, as Will is fond of saying as he prepares an objection, the unspecified sulfurous vilification on the part of an unidentified some does not justify the loony-toons McCarthyism of a member of the United States House of Representatives.

More funny, however, is Will's defense of Bachmann.  He writes:

Some of her supposed excesses are, however, not merely defensible, they are admirable. For example, her June 9 statement on the House floor in which she spoke of "gangster government" has been viewed on the Internet about 2 million times. She noted that, during the federal takeover of General Motors, a Democratic senator and one of her Democratic House colleagues each successfully intervened with GM to save a constituent's dealership from forced closure. One of her constituents, whose dealership had been in the family for 90 years, told her that the $15 million dealership had been rendered worthless overnight, and, Bachmann said, "GM is demanding that she hand over her customer list," probably to give it to surviving GM dealerships that once were competitors.

In her statement, Bachmann repeatedly called such politicization of the allocation of economic rewards "gangster government." And she repeatedly noted that the phrase was used by a respected political analyst, Michael Barone, principal co-author of the Almanac of American Politics, who coined it in connection with the mugging of GM bondholders in the politicized bankruptcy. Bachmann, like Barone, was accurate.

Some of Bachmann's excesses are defensible because (1) her speech on the house floor has been viewed 2 million times; (2) "respected political analyst (and not definitely right wing hack) Michael Barone coined the term she used repeatedly to describe the actions of a government run by a black guy.  I wonder if the term would have been as effective if the President were a white guy from Texas.  Probably not.  To open up a parenthesis, here's Michael Barone on the Democratic party (via Steve Benen):

that the Republican Party is the party of people who are considered, by themselves and by others, as normal Americans—Northern white Protestants in the 19th century, married white Christians more recently—while the Democratic Party is the party of the out groups who are in some sense seen, by themselves and by others, as not normal—white Southerners and Catholic immigrants in the 19th century, blacks and white seculars more recently.

Ah, normality–certainly a guy with views like that would mean gangster only in the most innocuous way. 

Anyway, back to the point.  One might concede that the bankruptcy of GM was politicized.  That's like the discovery of hot water.  Is it proper to describe political actions you don't agree with as a "mugging" or "gangster"?  I don't think so. 

UPDATE: turns out the "gangster government" allegation was shown to be false a mere two days after it was made.

I call “shotgun”

Today George Will is all about rights.  Rights are bad, you see:

If our vocabulary is composed exclusively of references to rights, a.k.a. entitlements, we are condemned to endless jostling among elbow-throwing individuals irritably determined to protect, or enlarge, the boundaries of their rights. Among such people, all political discourse tends to be distilled to what Mary Ann Glendon of Harvard Law School calls "rights talk."

Witness the inability of people nowadays to recommend this or that health-care policy as merely wise or just. Each proposal must be invested with the dignity of a right. And since not all proposals are compatible, you have not merely differences of opinion but apocalyptic clashes of rights.

Rights talk is inherently aggressive, even imperial; it tends toward moral inflation and militates against accommodation. Rights talkers, with their inner monologues of preemptive resentments, work themselves into a simmering state of annoyed vigilance against any limits on their willfulness. To rights talkers, life — always and everywhere — is unbearably congested with insufferable people impertinently rights talking, and behaving, the way you and I, of course, have a real right to.

People think and speak about rights in a lot of different ways.  Some rights they see as fundamental human rights, like the right to non-human-sacrificing religious expression; some rights are less fundamental, like calling shotgun or dibs.  These are rights too, but people, normal people anyway, would be quick to tell you that they don't rise to the level of basic human rights.  In addition to these two categories of right, there are also–perhaps unfortunately–the enumerated rights of the constitution.  I say "unfortunately" because some native-born English-speaking Americans struggle with reading and so they tire out after the Second Amendment, they one that says they can keep "bear arms."  The Ninth Amendment, you see, admits that one has other rights that are not enumerated in the Constitution's listing of the previous eight or eighty.

So the concept of right, even as it is used in ordinary speech, has a lot of meanings.  One must be careful before one asserts that someone means the one rather than the other(s).  Now of course George Will doesn't care about this at all.  He never cares about honestly representing the views of people with whom he disagrees.  I can tell this because of the toss-off line about health care and rights.  He suggests that this unwarranted assertion of rights is the foundation of arguments pro or con.  By my reading of the arguments, this comes up not very often.  Even if it did come up very often, George Will ought to reference it. 

Instead, the argument for the absurdity of all of this rights talk regards speed bumps in an affluent DC suburb:

Recently Paul Schwartzman, a war correspondent for the Metro section of The Post, ventured into the combat zone that is the Chevy Chase neighborhood in the District of Columbia. It is not a neighborly place nowadays. Residents are at daggers drawn over . . . speed humps.

Chevy Chase is, Schwartzman says, "a community that views itself as the essence of worldly sophistication." Some cars there express their owner's unassuageable anger by displaying faded "Kerry/Edwards" and even "Gore/Lieberman" bumper stickers. Neighborhood zoning probably excludes Republicans, other than the few who are bused in for diversity.

Speed humps — the lumps on the pavement that force traffic to go slow — have, Schwartzman reports, precipitated "a not-so-civil war . . . among the lawyers, journalists, policymakers and wonks" of Chevy Chase — and Cleveland Park, another D.C. habitat for liberals. The problem is that a goal of liberal urbanists has been achieved: Families with young children are moving into such neighborhoods. They worry about fast-flowing traffic. Hence speed humps.

And street rage. Some people who think speed humps infringe their rights protest by honking when they drive over one. The purpose is to make life unpleasant for the people who live on the street and think they have a right to have the humps. One resident, whom Schwartzman identifies as the husband of a former campaign manager for Hillary Clinton, recently sat on his porch and videotaped an angry driver who honked 30 times. Other honkers "gave residents the finger as they drove by."

Can't liberals play nicely together? Not, evidently, when they are bristling, like furious porcupines, with spiky rights that demand respect because the rights-bearers' dignity is implicated in them.

Fortunately, it is a short drive from Chevy Chase to the mellow oasis of the River Road Whole Foods store, where comity can be rebuilt on the firm foundation of a shared reverence for heirloom tomatoes. And if you, you seething liberal, will put the pedal to the metal you can seize the store's last parking place. So damn the humps, full speed ahead.

Note that nothing in Schwartzman's account mentioned "rights."  A mind-reading Will interjected the notion of "rights" as an explanation for why people–liberal hypocritical people of course–are rude.

But even if they were asserting their rights–they're not wrong.  It is an interesting question, after all, as to who gets to determine what the street in front of your house looks like.  It's a question more interesting than calling "shotgun" but less interesting than flag-burning.

He who denied it supplied it

I have a kind of a general rule here I stick by most of the time: the people worthy of criticism are people who can plausibly be said to have some effect on the opinions of a non-ideological set of people.  However right wing George Will is, many people (except Kramer) find him "intelligent"; so his arguments and factual assertions to them are well grounded and worth considering.  In a similar fashion, many conservative or moderate readers, will think Thomas Friedman and Richard Cohen represent decisive liberal voices.  So, when those two jokers come out in favor of the latest Mid-East policy disaster, then people who oppose it must be really crazy.  

I generally avoid (not always however!) ridiculously ideological venues such as the Wall Street Journal or the National Revue, I mean "Review."  I'm sure they have some role in the debate, but they get picked apart by other more competent people than me, and their arguments are mostly directed at inflaming the passions of the converted.

Just for fun, however, let's examine the following bit of ridiculousness from Daniel Henninger of the Wall Street Journal.  A propos of Obama's "socialism" he writes:

Don't expect "Capitalism" to make the White House theater.

The movie is largely a paean to plaintiffs lawyers and unions, who alas depend on evil capitalism for their incomes. Still, it's been noted that "Capitalism" slams Democratic Sen. Chris Dodd for being one of the unseemliest friends of Angelo Mozilo, the former CEO of Countrywide Financial, the famous subprime toxic waste site.

In fact, Mr. Moore holds up to ridicule a Who's Who of notable Democrats for selling out to the bankers: Tim Geithner, Larry Summers and Robert Rubin. At this point in Mr. Moore's narrative, all hope is lost, sinking beneath satanic capitalism.

But something happened, the movie says, that no one saw coming. "Change is what's happening." We are introduced to the presidential candidacy of Barack Obama (whose post-election supervisory link to the unseemly Geithner and Summers goes unremarked).

Of all the issues raised in the two-year campaign, Mr. Moore picks one, the famous charge that will not die: "Obama is a socialist."

Unlike the president, Mr. Moore doesn't duck. "The more they called Obama a socialist," he says, "the more he rose in the polls."

Michael Moore is a progressive saint. If he believes Barack Obama is a socialist camouflaged inside a Brioni suit, so must many of his fellow progressives.

This matters because the president's confused ideological identity has become an impediment to passing his agenda.

He says his health-care bill is not a Trojan horse for a Canadian-style single-payer system, but then feels forced to appear on five Sunday talk shows to prove otherwise; or he plants white-coated docs like plastic flamingos on the White House lawn.

On the first September anniversary of the end of Wall Street as we know it, Mr. Obama stood in the Federal Hall on Wall Street to say, "I've always been a strong believer in the power of the free market." Only a therapist could explain why some people say, "I've always been . . ."

You get a little of the ad hominem tu quoque in their at the opening (with a bit of false dichotomy–either capitalism or socialism are the only apparent choices), and some strange Michael Moore says "socialist" so ergo ipso fatso it must be true that many Obama supporters think he is (therefore Obama must be. . .).  The real silliness of this argument, however, consists in the claim that answering straw men attacks on your position means they are true.

That's a kind of double sophistry: you call someone a name, and then claim you're justified if the person bothers to tell you that you're calling her a name.  Why would she respond if it weren't true?

Argumentum ad Novi Eboraci Tempora

That would be "ad New York Times" I suppose.  I take as a matter or religious faith that global warming is a scientific issue, and that arguments concerning its reality or unreality should start and end there.  So when one frames the argument about global warming either in response to a Newsweek headline many years ago, or a New York Times article quoted out of context, I think that person is either not particularly well informed about how scientists work (they don't publish their work in the newspaper) or is just plain dishonest.  So George Will today frames his argument against the existence of a well-supported phenomenon by attacking the New York Times, as well as various context free quotes, meant–the quotes–to set up a pretty silly ad hominem.  

He writes:

Plateau in Temperatures

Adds Difficulty to Task

Of Reaching a Solution

— New York Times, Sept. 23

 

In this headline on a New York Times story about the difficulties confronting people alarmed about global warming, note the word "plateau." It dismisses the unpleasant — to some people — fact that global warming is maddeningly (to the same people) slow to vindicate their apocalyptic warnings about it.

The "difficulty" — the "intricate challenge," the Times says — is "building momentum" for carbon reduction "when global temperatures have been relatively stable for a decade and may even drop in the next few years." That was in the Times's first paragraph.

Whenever this guy quotes stuff, you'd better go read the original.  Here's what it says:

The plateau in temperatures has been seized upon by skeptics as evidence that the threat of global warming is overblown. And some climate experts worry that it could hamper treaty negotiations and slow the progress of legislation to curb carbon dioxide emissions in the United States.

Scientists say the pattern of the last decade — after a precipitous rise in average global temperatures in the 1990s — is a result of cyclical variations in ocean conditions and has no bearing on the long-term warming effects of greenhouse gases building up in the atmosphere.

The part about the scientists is where the argument ought to be.  Will instead insists that the real discussion is the political question of how to keep non-scientists from wrongly concluding, as Will has in this very piece, that the leveling off of temperatures means it's all a crock.  That's the point of the argument.  Will cites this piece extensively, and he seems to have no notion of what it's about.  Here's what he says:

The Times reported that "scientists" — all of them? — say the 11 years of temperature stability has "no bearing," none, on long-term warming. Some scientists say "cool stretches are inevitable." Others say there may be growth of Arctic sea ice, but the growth will be "temporary." According to the Times, however, "scientists" say that "trying to communicate such scientific nuances to the public — and to policymakers — can be frustrating." 

The quoted bits give the impression of some kind of fudging on the Times' part (like the black and white and weird voice in political commercials).  In any case, as I understand it, the basic point is this: The globe has heated up seriously for a quite a while.  Recently it has leveled off, but it still remains much hotter, so to speak, than before.  This is not unlike a guy with a really bad fever, experiencing a bit of dip, say a dip to 102.  He's still got a fever. 

Anyway, now for the ad hominem part:

The Times says "a short-term trend gives ammunition to skeptics of climate change." Actually, what makes skeptics skeptical is the accumulating evidence that theories predicting catastrophe from man-made climate change are impervious to evidence. The theories are unfalsifiable, at least in the "short run." And the "short run" is defined as however many decades must pass until the evidence begins to fit the hypotheses.

The Post recently reported the theory of a University of Virginia professor emeritus who thinks that, many millennia ago, primitive agriculture — burning forests, creating methane-emitting rice paddies, etc. — produced enough greenhouse gases to warm the planet at least a degree. The theory is interesting. Even more interesting is the reaction to it by people such as the Columbia University professor who says it makes him "really upset" because it might encourage opponents of legislation combating global warming.

This professor emeritus fellow is the only scientist Will cites in favor of his skeptical stance.  Nonetheless, the worry among scientists, justifiable as this piece indicates, is that people with no expertise will misunderstand the significance of the data.

 

If you like it so much

This episode has been repeated all over the place, but I'll repeat it here, just because it is so absolutely emblatic of the dismal state of our public discourse on health care.  Maria Bartiromo, a CNBC financial reporter (no really), played the role of a health care pundit yesterday, asking New York Democratic Congressional Representative Michael Weiner, 44, why he wasn't on medicare if he liked it so much.  Here is their conversation:

REP. WEINER: Listen, Carlos talks about Canada. You talk about Europe. Let's talk about the United States of America, Medicare —

MS. BARTIROMO: You have to look at where there are public plans.

REP. WEINER: No. No. The United States of America, 40 percent of all tax dollars go through a public plan. Ask your parent or grandparent, ask your neighbor whether they're satisfied with Medicare. Now, there's a funding problem, but the quality of care is terrific. You get complete choice and go anywhere you want. Don't look at —

MS. BARTIROMO: How come you don't use it? You don't have it. How come you don't have it?

REP. WEINER: Because I'm not 65. I would love it.

MS. BARTIROMO: Yeah, come on.

Now this is an obvious attempt, I stress "attempt" at ad hominem tu quoque.  For those who are new to fallacy analysis, and ad hominem argument is one where you discount a person's view because of irrelevant (that's important) facts about that person.  There are a few ways of doing that.  One way is to call their character into question, assail them with insults, and so forth: "your view is wrong because you have a weight problem!"  Another way–a very common one among small children–is to charge irrelevant hypocrisy.  So if your doctor says smoking is bad, yet she smokes, challenging the truth of the view with the fact of her smoking is irrelevant.  The doctor means that smoking is bad for anyone–including herself.  Indeed, one of the reasons it is bad is because it's addictive.

Now in this circumstance, Bartiromo, who I am not kidding is a financial reporter for a major US business cable channel, alleges that Rep.Weiner is a hypocrite for not opting for a health plan (medicare) he is not eligible for.  That means he can't even be a hypocrite.  Now all of this is even more silly from the point of view of the public option–where the government would offer a low cost alternative to private insurance.  It's a public option–not a public requirement.

When I hear this stuff–which is all of the time–and then I hear the likes of Michael Gerson, former speechwriter for George W. Bush (think, "axis of evil" and other belligerent pro-life Christian phrases) pronounce:

The incompetence of President Obama's health-care reform effort is undeniable, and unexpected. 

No amount of competence could counter the massive lies, distortions, scare tactics, and sheer ignorance of what calls itself "opposition to health care reform."  That is the premise of Obama's "defeat."

I can’t change my mind

Speaking of one of the weirdest op-eds I've ever seen, Bob Somerby (aka the Daily Howler) asks:

For years, we have asked why the professors don’t help us with our floundering discourse. When our journalists fail to serve, who don’t the professors step forward to help? Where are all the professors of logic, with their vast clarification skills? Why don’t the professors step in to straighten our broken logic?

The question is obviously rhetorical, but he continues to ask it, so here's an answer.  John Holbo, at Crooked Timber, is a professor of philosophy, and he has stepped up to the plate (as have many others).  Holbo recently addressed the very kind of argument Somerby was complaining about (here and here).  We talked about that here the other day.  But, just for fun, and because Bob wonders where the professors of logic are, and I'm one of those, let's have a look see at what he was talking about.  

The op-ed in question is by Danielle Allen, a professor at the Institute of Advanced Study (I'm not kidding).  She writes:

His administration now agrees with the analysts who argue that only by ensuring that no one games the system can reform be made to work. The mandate serves to ensure that individuals do not buy insurance only when they are ill. Other elements of the reform similarly serve to ensure that neither insurance companies nor employers will game the system. As Paul Krugman has argued in the New York Times, each of these strategies to prevent gaming is necessary to make the whole thing work. The point, though, is that the push for implementation has turned Obama's policies into something other than what he promised.

This change in Obama's position goes a long way toward explaining the objections to the new reforms that are being raised vociferously through grass-roots action by citizens on the right. The issue here is not that these citizens consider Obama untrustworthy — though they do. The issue, rather, is that they recognize that the stated goals and structure of a policy may not fully capture its full range of outcomes in practice. This is why these citizens, including professionally briefed participants such as Sarah Palin, can continue to maintain, in the face of a barrage of insistences to the contrary, that the reforms will (1) result in rationing and (2) establish "death panels."

Gee professor, as others have pointed out (here and here for examples), every one is justified in making the most outlandish slippery slope arguments since it is a fact of nature that the "stated goals and structure of a policy may not fully capture its full range of outcomes in practice."  And no, for the love of Mike, a change in a proposal does not open the door to that inference, as she suggests.  While perhaps not a fact of nature qua nature, I think moderate (or even extreme) changes in the positions one advocates are a normal reaction to the facts on the ground.

Think about this for a second.  Given the professor's argument, no policy maker (or person) can change a position without having her real motives stretched to include the most extreme and unlikely consequence.  So, take heed, policy people, if you change your mind ever so little then Danielle Allen will wonder whether you really want to turn old people into Soylent Green.

You’re just saying that because it’s true

One day someone with more time than me will write about the various forms of meta debate.  By "meta debate" I mean, of course, discussions about the various forms and rules of "debate" (a word I don't like so much) or "discussion." Here's an example of a particularly pernicious form of meta debating (courtesy of Sadly,No!):

Pointing out that both sides engage in the same tactics, and that, in this case, one set of tactics seems to be unrelated to a substantive policy outcome neither presuppose the truth of one side of the debate nor does it presuppose that one side of the debate isn't actually, ultimately, right.  In the same way, it is illogical to assume that because one side distorts the debate far more than the other side, the debate itself ought to turn out in any prescribed way.  When I write things like this, it drives some partisans absolutely crazy. They don't like where the I'm drawing the "truth" line, and instead of reading the judgments that I've made — the Right is appealing to anger and fear and is distorting the debate more — they focus on the link that I won't then make — the link that I have no expertise to make — the link that, if I were to make it, I would be guilty of an offense against democracy — the link between what IS and what OUGHT to be. 

This is not actually that bad of a disclaimer (save for the confused "is-ought" business at the end.  Nonetheless, where this fellow's observations fall on rocky soil (I just heard that phrase the other day) is earlier in the piece.  He writes:

The field of cognitive neuroscience has all but given up trying to distinguish between emotion and reason, but political debate evidently lags far behind the science. Some observers of health care politics, particularly on the left, tend to accuse their opponents of trying to trigger emotional panic points rather than argue dispassionately about the facts. The implication is that the Right doesn't have any facts, so it looks to exploit voters' fears. There is something to be said for this argument, but it's not what proponents would have you believe. In policy debates where the target voter claims an independent identity, the side that's proposing something usually has a set of normative facts, and the side that's against something always appeals to that which most powerfully undercuts a fact. Democrats and Republicans both use emotion, but they use it differently, and use it to achieve different goals. 
 
The pro-reform side is appealing to emotion, too — albeit a wholly different emotion — the self-satisfaction one feels when one believes one has rationally deliberated something and meaningfully contributed to an important public debate.  This is called a solidary incentive. It's a powerful — and often completely ignored — sentiment, one that the Obama presidential campaign found, capitalized on, and won the election by exploiting.

As an empirical matter, I think this observation is just plain false.  Both "sides" (there are more than two for Pete's sake), appeal to facts.  The screaming Mimis at the town hall meetings (who are largely opposition types) come harmed with "facts" that have produced "emotions" although emotions of a decisively negative kind (relative to the things being proposed).  Let me put that another way: given the facts as they know them, they really hate the proposals.  The degree of their hatred of the proposals does not (for a careful observer) accentuate or diminish the basic factual assertions some of them seem to make.  In other words, they're not wronger or righter because they're screaming.  Maybe they're just jerks for that.  But that's a different question.

The real idiocy here of course consists in the claim that the side whose appeal is primarily factual (in the silly description offered here) is also appealing to emotion–the satisfaction one gets from doing the right thing.  I mean, again, for Pete's sake.  This is the lowest form of ad hominem argument: attacking someone because they're eager to have the correct position.  There's no defense against this.

I don't mean to allege that the screaming Mimi opposition doesn't have the right answer.  I think they think they do.  This author's analysis here is too shallow and too facile to bother with such weighty questions.  Instead, we are treated to the silliest form of meta debate analysis.  Everybody poops.

Would I lie to you?

In the department of distinctions, today we have the following (via Steve Benen):

There are a lot of angry nuts on my side of the aisle [the right].  They simply can’t believe that Barack Obama somehow got elected president and they feel powerless right now.

But here’s the thing:  There’s plenty of crazy to go around.  Remember Bush Derangement Syndrome?  The 9/11 conspiracy theorists who thought Bush and Cheney were in on the whole thing?  The Diebold plot to steal the 2004 election?  Should we judge the Left by the whackos that show up at the anti-trade rallies?  PETA?  Greenpeace?  Of course not.  Almost by definition, the people motivated and available enough to show up in the middle of the day to express their outrage about something are not like you and me.

"Bush Derangement Syndrome" was shorthand (invented by Charles Krauthammer, of all people) for the (fallacious) ad hominem tactic Bush supporters used to malign critics of all things Bush.  So, saying, "Remember Bush Derangement Syndrome" as evidence of the wrongness of your opponent is like saying, "Don't you remember how I used to lie about you, didn't that show you were wrong?"

 

Why don’t they live by it?

E.J. Dionne tries out an argument against concealed carry laws, with disastrous results.  He writes:

Isn't it time to dismantle the metal detectors, send the guards at the doors away and allow Americans to exercise their Second Amendment rights by being free to carry their firearms into the nation's Capitol?

I've been studying the deep thoughts of senators who regularly express their undying loyalty to the National Rifle Association, and I have decided that they should practice what they preach. They tell us that the best defense against crime is an armed citizenry and that laws restricting guns do nothing to stop violence.

If they believe that, why don't they live by it?

. . . . 

Don't think this column is offered lightly. I want these guys to put up or shut up. If the NRA's servants in Congress don't take their arguments seriously enough to apply them to their own lives, maybe the rest of us should do more to stop them from imposing their nonsense on our country. 

This argument has the sour flavor of the ad hominem tu quoque: If Senators in favor of concealed carry laws were serious, they would not permit gun restrictions at their own place of work (they don't, so their argument is wrong).  That criticism is silly and misdirected.

I think these senators would consent to people carrying weapons around them at other places (say at their local Qwik E Mart in their home state)–at least that's what the laws they support allow.  The US Capitol is an exception to such laws (for reasons too plain to mention).  So the other part of this argument is a nearly textbook fallacy of accident: applying a general rule to an obvious exception.

As one who opposes relaxing gun laws (most of the time), I find this argument (and this endorsement of it) embarrassing.
