Rationalizing the ratio

Often, as we’ve noted before, columnists eschew careful argument altogether preferring textbook rhetoric to assert and bolster a basic claim. Krauthammer’s column today fits this bill. “Disproportionate in What Moral Universe? rejects the claims that the Israeli response to the recent Hezbollah initiated conflict is “disproportionate.”

In just war theory it is a proportionality between the use of force and the end that is being achieved by the use of force (and not “tit for tat”). It’s not clear that Krauthammer has this notion in mind. He seems to equivocate on the notion of proportionality throughout his column. Generally he suggests that the Israeli response is not out of proportion to the Hezbollah attacks:

In perhaps the most blatant terror campaign from the air since the London Blitz, Hezbollah is raining rockets on Israeli cities and villages. These rockets are packed with ball bearings that can penetrate automobiles and shred human flesh. They are meant to kill and maim. And they do.

Israel’s response to Hezbollah has been to use the most precise weaponry and targeting it can. It has no interest, no desire to kill Lebanese civilians. Does anyone imagine that it could not have leveled south Lebanon, to say nothing of Beirut

But, the notion of proportionality should be sought between the end and the means:

On Wednesday CNN cameras showed destruction in Tyre. What does Israel have against Tyre and its inhabitants? Nothing. But the long-range Hezbollah rockets that have been raining terror on Haifa are based in Tyre. What is Israel to do? Leave untouched the launch sites that are deliberately placed in built-up areas?

The end that the Israeli government offers is the safety of its citizens achieved by disarming/weakening Hezbollah and creating a buffer zone in southern Lebanon. Proportionality thus requires that the force used is in proportion to the effect desired. Another way of expressing this would be to say that the military means should be enough to effect this goal without causing additional destruction or damage. If they destroy more than is needed to effect the goal, then the case that their war is just will be undermined.

The claims of “disproportionate” response arise because it seems very likely that Israel is targeting sites outside of southern lebanon and with not obvious connections to Hezbollah (relief trucks, Lebanese military bases, UN observer posts, communication resources, infrastructure, etc.) In addition they are targeting areas where there is “support” for Hezbollah resulting in civilian casualties. The Israeli government would claim that Hezbollah is using civilian populations as “human shields.” (Salon has an interesting piece claiming that Hezbollah militants mistrust civilian populations here).

But while granting that the Israeli government has the right to respond to the attacks and eliminate the threat of future attacks by Hezbollah, critics are arguing that many of the targets are spurious for these goals. We can’t evaluate the truth of that claim here. But the burden of proof lies with the perpetrator of the acts and such proof is not provided by Krauthammer’s vague and unsupported claims about legimate targets and military necessities.

Nevertheless, whether this is true or not, Krauthammer does not address the real question of whether targeting Lebanese army bases and relief trucks is justified by the proportionality requirement. Instead he equivocates between two senses of proportionality, with an excessive rhetoric that would justify virtually any act of violence committed in the Israeli attack.

Not even counting the dichotomy. . ..

We’ve left David Brooks alone for a while now, ever since the NYT decided that their op-ed columnists could generate revenue. But I’ll return to Brooks, with apologies for the impossibility of linking to the whole editorial.

As our readers know, Brooks has probably never thought up an over-simplifying sociological dichotomy that he wasn’t impressed with and convinced contained profound insights into politics and society.

In the world of public policy, there are ecologists and engineers. The ecologists believe human beings are formed amid a web of relationships. Behavior is shaped by the weave of expectations and motivations that we pick up from the people around us every day.

In contrast there are “engineers” who believe that rational behavior can be effected through offering incentives. This dichotomy like most of Brooks’ simplifications conceals more than it reveals. One suspects that most people are more like ecological engineers. But, we won’t even count the irrelevant dichotomy in his column.

Nevertheless, the object of Brook’s column is a Democratic Leadership Council plan to increase the financial resources available for College. This he claims ignores the ecology of college graduation.

A case in point: Over the past three decades there has been a gigantic effort to increase the share of Americans who graduate from college. The federal government has spent roughly $750 billion on financial aid. Yet the percentage of Americans who graduate has barely budged. The number of Americans who drop out of college leaps from year to year.

So, according to Brooks the percentage of students who graduate has barely budged and the number of College drop outs has increased, despite spending three quarters of a trillion dollars! What’s going on here?

For one thing, the number of college graduates has increased dramatically over the “past three decades.” (US Department of Education claims 5.8 million full time students in 1970 and around 10 million in 2005). So the really significant number is not the graduation rate but the number of college graduates. Thirty years ago only 47% of high school graduates attended college. In the mid-90’s it was around 66%. In addition the percentage of Americans in the workforce with a Bachelor’s degree has increased in the past ten years from 26% to 33%.

Brooks seems to be doing some fairly standard manipulation of statistics to suggest that 750 billion of tax payer money has not had any significant benefit. He may be correct. But the picture is far more complicated than he admits and his argument for this conclusion is extremely weak. We would probably call this “suppressed evidence.”

Second, it isn’t entirely clear that financial aid is thought to have such a simple relationship to graduation rates. Financial resources are obviously a necessary condition but not a sufficient condition of college graduation. The question that we would need to ask is not whether financial aid has increased the graduation rate, but whether it is affected the graduation rate. Perhaps, and indeed, quite plausibliy, without that 750 billion in financial aid many more students would not have considered attending college, or the drop-out rate might have increased.

The only evidence that Brooks offers against this is the claim that only 8% of students are “driven away by purely financial reasons.” I’m not familiar with this research, but it strikes me that “financial reasons” are rarely “purely” the cause, since struggling with finances have many other effects for students.

But as an “ecologist,” Brooks thinks that providing financial assistance for college is a insufficient condition for affecting college graduation rates.

You have to promote two-parent stable homes so children can develop the self-control they need for school success. You have to fundamentally reform schools. You have to expand church- and university-sponsored mentoring programs and support groups. As Caroline Hoxby of Harvard notes, you have to surround students with people who will help them make informed decisions so they can attend a college they find useful.

Perhaps that is so. But the impression that the only thing the DLC’s proposal amounts to is throwing money at the middle class to buy votes is a gross oversimplification of the problems of rising costs of higher education.

New Rights

A new law makes it a federal crime to cross state lines to avoid abortion parental consent laws. In describing the motivation of his support of the bill, Mitch McConnell, republican senator from Kentucky, said:

>”No parent wants anyone to take their children across state lines or even across the street without their permission,” Senate Majority Whip Mitch McConnell, a Republican of Kentucky, said. “*This is a fundamental right*, and the Congress is right to uphold it in law.”

As I read the Constitution of the United States of America, it doesn’t say anything about parental rights, or parents, or even children. So, I wonder such a fan of “strict constructionists” justifiies this strange new *fundamental* right. Is it perhaps penumbral? Is it somehow emboddied in the other explicitly enumerated rights of the Constitution?

Chicken soup for the argument

Though I have no doubt David Brooks is unaware of us–especially since we almost never comment on him as he is firewalled–I was surprised to see that something of the idea of whom to ask critical questions about people places and things has crossed his mind:

>It happened just over a year ago in Key West, of all places. We’d come down for a conference organized by the Pew Forum on Religion and Public Life, and one afternoon two friends, Reuel Gerecht and Jeffrey Goldberg, squared off for a debate on the prospects for democracy in the Middle East.

>Gerecht and Goldberg are Americans whose fascination with Islam has taken them to *ridiculous places.* Gerecht, a former member of the C.I.A. clandestine service, spends an astonishing amount of time in spare rooms in Middle East backwaters talking fatwas in klatches with bearded fundamentalists.

>Goldberg has lived in a madrasa in Pakistan. His pieces from inside Hezbollah won a National Magazine Award for The New Yorker. In the fall he has a book, “Prisoners,” coming out about his time as a prison guard in the Israeli Army, and his friendships with the Palestinian detainees.

You read that right–“ridiculous places”–as if to foreshadow where we are going in this piece.

Believe it or not, these two individuals “disagree utterly about the path to Arab democracy.” But which *one* of them will be right? The Middle East is such a *ridiculous* place, so how better to resolve the dispute about its future between two ridiculously adventurous westerners (they actually went to the Middle East and talked to those people? That’s ridiculous!) than with a ridiculous analogy:

>The only way to reform the Middle East, Gerecht concluded, is by changing political institutions and enduring as the spirit of democratic self-government slowly changes society. *There will be a period of fever, but the fever will break the disease.*

What a fitting analogy! But wait:

>When it was Goldberg’s turn (the transcript is available online at pewforum.org), his first observation was that *sometimes fevers break the disease but sometimes they kill the patient*.

Zing! Excellent point Dr.Goldberg! How will the moderator resolve it?

>What this debate is really about is *the mother of all chicken-and-egg problems.* Can we use political reform *to spark* cultural change, or do we have to wait for cultural reformation before *we* can change politics?

The concept of agency at work in this piece is so 19th Century: why bother asking people from the land of the ridiculous to participate? (maybe, and this is admittedly a ridiculous suggestion, they have another view, or views). Surely they couldn’t have come up with the chicken and egg metaphor for their predicament–that’s why they’re ridiculous.

Question answered

Why do the Israelis fight, asks Charles Krauthammer, especially in light of the following circumstances:

>Exhibit A: Gaza. Just last September, Israel evacuated Gaza completely. It declared the border between Israel and Gaza an international frontier, renouncing any claim to the territory. Gaza became the first independent Palestinian territory in history. Yet the Gazans continued the war. They turned Gaza into a base for launching rocket attacks against Israel and for digging tunnels under the border to conduct attacks such as the one that killed two Israeli soldiers on June 25 and yielded a wounded hostage brought back to Gaza. Israeli tanks have now had to return to Gaza to try to rescue the hostage and suppress the rocket fire. [emphasis added]

I’m very much a non-expert about the region (see previous post), but I’m curious about the language Krauthammer employs.

In the first part of the paragraph, Israel is the agent–it declares it has no claim on Gaza (where’s Gaza in this? Was it agreed that the case was then closed by Israel’s withdrawl?).

Despite Israel’s action Gaza continues (unreasonably we can only suppose–at least Krauthammer doesn’t mention any reasons) to wage “war”.

In this “war” the Gazans captured a “hostage”. Typically in war one captures “prisoners.” One might wonder if Israel has any “hostages”. Or do they have “prisoners”? Perhaps like us they have “detainees.”

Now in light of the action of the Gazans, Israel is forced into the role of passive responder: they have had to–they have no choice but to–return to Gaza with tanks. As I say, I’m not an expert, but maybe there were other options.

Happiness

Richard Cohen, one of the Washington Post’s “liberals” pens a column on gay marriage: he’s for it. In arguing for it, however, he makes the following puzzling distinction:

>Gay marriage, like abortion, is a highly emotional issue and, at the moment, commands nowhere near overwhelming support. Depending on how the question is asked, and the polling organization itself, anywhere from 40 to nearly 60 percent of Americans oppose same-sex marriage. If the latter figure is accurate, permitting same-sex marriage by judicial fiat would produce yet another protracted fight over yet another social issue. Roe has been bad enough, thank you.

Then he says,

>Yet the case for same-sex marriage is so much clearer and easier to make than the complexities that produced the tortured reasoning of Roe . It is based primarily on the easily understood and widely accepted words of the Declaration of Independence: “life, liberty and the pursuit of happiness .” Since none of the counterarguments can prove any damage at all to society, the New York state high court missed a chance to further an education process and, justly, grant to homosexuals and lesbians the benefits of marriage so casually granted to heterosexuals. Way before getting to 316, it’s clear one of the benefits is as American as apple pie: the pursuit of happiness itself.

It’s hard to appreciate Cohen’s distinction between these two cases: abortion and gay marriage raise fundamental constitutional questions (especially when people organize to deny access to them). It’s obvious to many that gay marriage and the right to abortion follow from simple constitutional principles (and so are the proper objects of judicial review–what he calls “judicial fiat”).

But it’s not obvious to some disproportionately vocal and (at times) violent individuals. They think such things do not follow easily from the foundational principles of the constitution. While they are likely wrong, Cohen ought to show them how they are wrong. Merely claiming that gay marriage, but not (puzzlingly) reproductive rights, follow from the “pursuit of happiness” begs the question in the most textbook fashion: he asserts without argument what he needs to demonstrate.

My way or the highway

After a brief excursus on the wonders of–get this–taxpayer funded interstate highways (what he would in other circumstances call “welfare”) George Will concludes:

>American scolds blame the IHS and the automobile for everything from obesity (fried food at every interchange) to desperate housewives (isolated in distant suburbs without sidewalks).

I’m beginning to think he just can’t help himself: every view of his must be presented against a completely ridiculous alternative. In what could have been an innocuous piece about the virtues of highways, turns out to be whiny piece about people who would suggest they aren’t an unqualified good:

>This senator who did so much to put postwar America on roads suitable to bigger, more powerful cars was Al Gore Sr. His son may consider this marriage of concrete and the internal combustion engine sinful, but Tennessee’s per capita income, which was just 70 percent of the national average in 1956, today is 90 percent.

So, Al Gore, who has foolishly and sanctimoniously suggested we might rethink our dependence on fossil fuels (an inexhaustible resource), simultaneously betrays his father, his home state, his country and reason. The only way to account for Tennessee’s prosperity–and the only way it could have happened, and thus the only way it can be maintained–is with bigger and more fuel-guzzling cars.

Even crazed environmentalists appreciate the freedom of the open road (well maintained with tax dollars), perhaps they just don’t think it should be the only way to get around.

I fear the Greeks

Especially when they are bearing gifts. George Will pens an approving and quote-rich column about Peter Beinert’s new book, *The Good Fight: Why Liberals — and Only Liberals — Can Win the War on Terror and Make America Great Again.* Beinert, in Will’s fawning presentation, rejects the progressive label in favor of believe it or not “liberal.” But this is liberal in a new sense: the hawkish anti-terror liberal, not the Saddam-loving, Bin Laden-excusing Michael Moore style liberal:

>But while excoriating the Bush administration for perhaps “creating exactly the condition the conservatives have long feared: An America without the will to fight,” Beinart’s most important contribution is to confront the doughface liberals who rejoice about the weakening of that will. Reading liberals who seem to think they “have no enemies more threatening, or more illiberal, than George W. Bush,” Beinart worries that Deaniac liberals are taking over the Democratic Party much as McGovernite liberals did after 1968. He discerns the “patronizing quality” of many liberals’ support for John Kerry in 2004: They “weren’t supporting Kerry because he had served in Vietnam. They were supporting him because they believed other, more hawkish, voters would support him because he had served in Vietnam.”

It’s fun to question people’s motives, but it’s impolite to confuse the motives imputed to them. So while many liberals may perhaps share the satisfaction of having been right about Iraq and Afghanistan from the very beginning, this does not mean (1) that they are gleeful over the damage that has been done to America, and more perniciously, (2) that they brought it about or desired it. The current weakening of America’s standing in the world was one of the arguments *against* silly saber rattling and thinly justified foreign misadventures, not the desired outcome. Taking them to task for having been right all along, as is the current fashion among those who were wrong all along, is like blaming mathematics for your inability to add.

One final point, the oft repeated meme that liberals disdain military service has never been borne out by the facts. A simple survey of leading democrats (vs. Republicans) who actually served their country should dispel this view.

Cut and run

Before he was swept up in a spam patrol sweep, a loyal reader of ours suggested we take a look at the Power Line Blog. He wrote:

>I would like to request that this blog focus a bit on another blog for the purpose of identifying and analyzing the methods of argumentation used there. The blog is Powerline and it is a conservative blog of some influence, although I cannot for the life of me determine why it should be so. In particular, please look over the posts of one of the site’s main contributors: Paul Mirengoff. He has been the subject of a previous post on this blog when he co-authored a Wash Post editorial. I think his posts are rife with certain techniques that debaters often use and which are used to hide some very interesting logical flaws, albeit always that easy to spot. The manner in which he consistently dismisses those with a viewpoint of which he disapproves strikes me both as unresponsive and as an ad hominem approach to argument. I’d be most appreciative of anyone’s observations here — I’ve no particular subject matter or viewpoint at stake here, but I am more than a little puzzled as to why Powerline is given so much credence in the blogosphere and elsewhere.

We’re generally not interested in blogs–it’s all we can do to read the op-eds of the major daily newspapers. As a way however of apologizing to this loyal reader, here’s a quick analysis of a brief Powerline passage:

>The fact that half of all deaths caused by terrorists last year were in Iraq is consistent with what the terrorists themselves often tell us: Iraq is the central front in the global war against Islamic terrorism. The old Andrew Sullivan would have understood that this means we should fight to win in Iraq, not cut and run.

Nevermind that Iraq hadn’t been a central front in the war on terrorism until we made it so by showing up there. The more interesting claim is the second–we should fight to win, not cut and run. “Cutting and running” has all the air of the straw man/false dichotomy. “Cutting and running” is not a strategic manuever; it is hasty, cowardly, and as a result ill-conceived. It is not a policy that any serious person advocates, or should be considered to advocate. So for that reason the powerline blogger blogs against no one. The false dichotomy consists in the implicit claim that the only alternative to “victory” (whose definition is always shifting, by the way, but that is another matter) is cowardly retreat. The alternative to victory, however, is defeat. A road that many claim we have already chosen. But that, again, is another matter.

Maxima culpa (eorum)

On the subject of straw men, the Associated Press could also have noted that the President is not alone in ridiculing his opponents–he is just less adept at it. In today’s *Washington Post*, Fareed Zakaria tears a page from the President’s play book; but befitting a professional opiniator, he does it with more subtlety.

After a string of *culpae eorum* (their, not his, faults) regarding the failures of intervention in Iraq, Zakaria asserts:

>And yet, for all my misgivings about the way the administration has handled this policy, I’ve never been able to join the antiwar crowd. Nor am I convinced that Iraq is a hopeless cause that should be abandoned.

Note that “hopeless” and “abandoned” sound a lot like “cut” and “run”–only less Texan. Nowhere in the piece does Zakaria address the reasonable (but not necessarily correct) alternatives to his strategy of staying the course–outside of, that is, the phrase “antiwar crowd.” So, one might surmise that the only other option to continuing with our increasingly disastrous (body count, political instability, etc.) intervention is the anti-war crowd. Despite his more reasoned tone then, Zakaria has used the straw man “some say” technique as the president, and as such, it is impossible for the reader to determine whether his three arguments for staying are any good.

Luckily, however, one doesn’t need to have present to mind an alternative to see just how bad these reasons are.

The first:

>So why have I not given up hope? Partly it’s because I have been to Iraq, met the people who are engaged in the struggle to build their country and cannot bring myself to abandon them.

And the oaths of TV pundits are written on water.

Second:

>there is no doubt that the costs of the invasion have far outweighed the benefits. But in the long view of history, will that always be true? If, after all this chaos, a new and different kind of Iraqi politics emerges, it will make a difference in the region.

It may or may not always be true that Iraq will be a disaster. But it’s very likely that it will be. It’s only getting worse. The possibility of it not being the case is hardly reason to stay. And it has made a difference in the region–it has emboldened Iran and served as a training ground and recruiting depot for all sorts of new terrorists.

Finally:

>These sectarian power struggles can get extremely messy, and violent parties have taken advantage of every crack and cleavage. But this may be inevitable in a country coming to terms with very real divisions and disagreements. Iraq may be stumbling toward nation-building by consent, not brutality. And that is a model for the Middle East.

A “sectarian power struggle” sounds like code for bloody religious civil war where the victor is determined by brutality and force of arms (and perhaps Iranian intervention, among other such things). How this means they are stumbling toward nation-building by consent is simply a mystery. All of the evidence Zakaria cites points in the other direction.

But again, these three really bad reasons only make marginal sense in the context of an absurd alternative. Perhaps one as knowledgeable of foreign affairs as Zakaria could find the time to research some of them.
