Refutation

So you want to refute–i.e., prove to be false–someone else’s generalization. There’s only one way that I can think of: show that the generalization is false. That means your evidence of its falsity must be as general as the claim itself. Pointing out exceptions to a generalization only demonstrates your inability to grasp one foundational notion of informal reasoning. Two examples of this from our dear friend, George F. Will:

>Once America’s most industrialized city, Newark attracted the attentions of New York mobsters (the movie “On the Waterfront” was filmed on New Jersey docks) whose depredations contributed to the flight of industry just as blacks were arriving from the South. Partly because of the cost that organized crime added to many city contracts, Newark spent twice as much per citizen as did other midsize cities. And the riots came, (redundant) evidence of the problematic nature of attempts to spend one’s way to domestic tranquility.

The first part of this paragraph shows how the spending in Newark was uniquely corrupt. How that then can be evidence for the claim that spending does not equal domestic tranquility baffles: it wasn’t effective spending. Unless, of course, Mr.Will means to refute the view of the person who says: “all social spending–including the corrupt cosa nostra kind–ensures tranquility–and if you find one counterexample, I will be wrong.”

Here’s the second:

>Today, per-pupil spending tops $17,000, which is 75 percent above the national average and a (redundant) refutation of the public education lobby’s not disinterested judgment that in primary and secondary education, cognitive outputs correlate with financial inputs. Seventy percent of Newark’s 11th-graders flunk the state’s math test. Booker says that under the previous mayor’s administration, every elected official sent his or her children to private schools.

Again. That’s hardly a “refutation” of that rule. It’s a counter-example. And perhaps a reminder that not just any money counts. Money well spent counts. I think that’s probably what the rule means.

But in both cases, in order to show the falsity of the generalization being refuted, Mr.Will will have to come up with a more representative counter-example than the city awash in mob corruption (on account, in part, because of its place in global trade–the port of Newark). If he wants actually to say something true, then perhaps he ought to try to do a little non-Heritage foundation research.

Liberalism is dumb

Yesterday, George Will made his case for “conservatism.” This mainly involves making the case against Mayor Quimby, the corrupt and degenerate mayor of the fictional town of Springfield on the Simpsons. For in making the case for conservatism, Will presumes there is only one alternative–his. There may indeed be two major parties, but hardly anyone at this point can claim that they divide along the lines Will suggests–one is for freedom, the other for equality. The one that ought to be for freedom–the conservative one–openly advocates the rollback of plain-language constitutional guarantees; while the one that’s for equality over freedom, often comes out for freedom over equality. If we had more patience with this, we’d say what Will means is the freedom of individuals (which includes corporations, but not unions of workers) to make money without government restraint; but not the freedom of individuals to seek redress through the courts. Someone else can make that case. We’d just like to point out the silly straw man, and consequent false dichotomy. Someone really ought to make the case for “conservatism” in a way that does not presuppose some dumb-ass liberal view. Liberalism after all has its John Rawls.

Here’s the straw man:

>Liberals tend, however, to infer unequal opportunities from the fact of unequal outcomes. Hence liberalism’s goal of achieving greater equality of condition leads to a larger scope for interventionist government to circumscribe the market’s role in allocating wealth and opportunity. Liberalism increasingly seeks to deliver equality in the form of equal dependence of more and more people for more and more things on government.

>Hence liberals’ hostility to school choice programs that challenge public education’s semimonopoly. Hence hostility to private accounts funded by a portion of each individual’s Social Security taxes. Hence their fear of health savings accounts (individuals who buy high-deductible health insurance become eligible for tax-preferred savings accounts from which they pay their routine medical expenses — just as car owners do not buy insurance to cover oil changes). Hence liberals’ advocacy of government responsibility for — and, inevitably, rationing of — health care, which is 16 percent of the economy and rising.

>Steadily enlarging dependence on government accords with liberalism’s ethic of common provision, and with the liberal party’s interest in pleasing its most powerful faction — public employees and their unions. Conservatism’s rejoinder should be that the argument about whether there ought to be a welfare state is over. Today’s proper debate is about the modalities by which entitlements are delivered. Modalities matter, because some encourage and others discourage attributes and attitudes — a future orientation, self-reliance, individual responsibility for healthy living — that are essential for dignified living in an economically vibrant society that a welfare state, ravenous for revenue in an aging society, requires.

Right. Now the false dichotomy:

>This reasoning is congruent with conservatism’s argument that excessively benevolent government is not a benefactor, and that capitalism does not merely make people better off, it makes them better. Liberalism once argued that large corporate entities of industrial capitalism degraded individuals by breeding dependence, passivity and servility. Conservatism challenges liberalism’s blindness about the comparable dangers from the biggest social entity, government.

Liberals pro-government. Government bad. Conservatives anti-government. Anti-government good. Conservatism good.

Brooks on Gore III

Lots to choose from today: Sam Brownback’s evolution confusion or George Will’s “Case for Conservatism” (which is, as one would suspect, the case against his cartoonish liberal with the subsequently unjustified claim that this makes the case for his view–which it doesn’t). But David Brooks’ column the other day still offers some final ignorant tidbits. So far, the reader may remember, Brooks has accused Gore of favoring some kind of vulcan-like existence because he wants people to argue with facts and logic.

The final paragraphs of Brooks piece descend into nonsense. He writes:

> This, in turn, grows out of a bizarre view of human nature. Gore seems to have come up with a theory that the upper, logical mind sits on top of, and should master, the primitive and more emotional mind below. He thinks this can be done through a technical process that minimizes information flow to the lower brain and maximizes information flow to the higher brain.

Now the mind is identical to the brain? Doesn’t that make Brooks a determinist?

>The reality, of course, is that there is no neat distinction between the “higher” and “lower” parts of the brain. There are no neat distinctions between the “rational” mind and the “visceral” body. The mind is a much more complex network of feedback loops than accounted for in Gore’s simplistic pseudoscience.

>Without emotions like fear, the “logical” mind can’t reach conclusions. On the other hand, many of the most vicious, genocidal acts are committed by people who are emotionally numb, not passionately out of control.

Now we’ve veered far from the discussion of civil discourse, into simplistic (ironically it seems) pseudo-science about the nature of reasoning and consciousness and their relation to brain processes.

>Some great philosopher should write a book about people — and there are many of them — who flee from discussions of substance and try to turn them into discussions of process. Utterly at a loss when asked to talk about virtue and justice, they try to shift attention to technology and methods of communication. They imagine that by altering machines they can alter the fundamentals of behavior, or at least avoid the dark thickets of human nature.

>If a philosopher did write such a book, it would help us understand Al Gore, and it would, as he would say, in fact, evoke a meaningful response.

I don’t think any philosopher would write a book of that sort, as it rests on a confusion between argument and explanation. Brooks can’t bring himself to consider Al Gore’s argument, so he distorts it, and then asks what would explain such a distorted view. Ironically, even Gore’s distorted view is superior, on Brooks’ own grounds, to Brooks’ brain state analysis of human nature.

Perhaps Gore can include Brooks unreasoning response as an appendix in a subsequent edition of his book about the assault on rational discourse.

Memorial Day

It’s Memorial Day. George Will, one-time ardent supporter (“The Case for Bush“) of the man who has created the mess we’ll be in for a long time, reflects on its significance:

>The Constitution’s Fifth Amendment says no property shall be “taken” without just compensation. The concept of an injury through “regulatory taking” is familiar and defensible: Such an injury occurs when a government regulation reduces the value of property by restricting its use. But the taxi cartel is claiming a deregulatory taking: It wants compensation because it now faces unanticipated competition.

Taxis in Minneapolis. Sure, immigration has been in the news. But not everything is an opportunity to make such pseudo-libertarian points. As a low-tax, civil liberties kind of guy, perhaps Will might be interested in the more obvious theme of the weekend–the war in Iraq. Aside from the sheer murderous folly of our entire Middle East venture, the erosion of the plain-language civil liberties of the constitution and the executive’s groundless assertions of power seem more pressing than crappy arguments by anecdote against Will’s silly view of “liberalism.”

Probably better for folks to meditate on this:

>Parents who lose children, whether through accident or illness, inevitably wonder what they could have done to prevent their loss. When my son was killed in Iraq earlier this month at age 27, I found myself pondering my responsibility for his death.

And he was against the war.

Full of gas

George Will’s faith in free markets knows no bounds. Any suggestion that gas prices are too high results in all sorts of unrestrained sophmoric vitriol–supported by research from the American Enterprise Institute of all places. As always, an argument can be made that gas is not as high as it used to be (adjusted for inflation and so forth), but that’s not really the point. Gas has more than doubled in price very suddenly. On top of that, more and more people are dependent on it being cheap (don’t get me wrong, that’s not a right). That creates a good deal of shock. But the fact that people keep driving doesn’t mean they don’t care about the price, as Will seems to think:

>Democrats, seething at the injustice of gasoline prices, have sprung to the aid of embattled motorists. So resolute are Democrats about defending the downtrodden, they are undeterred by the fact that motorists, not acting like people trodden upon, are driving more than ever. Gasoline consumption has increased 2.14 percent during the past year.

It means they don’t have a choice. The more relevant question would be whether people continue to engage in frivolous driving. Or if people who engage in unnecessary driving make cuts elsewhere. In either case, the simple fact of continued gas buying doesn’t establish anything about the mental state of the purchaser.

But here’s the real gem of whiny sophomoric libertarianism:

>Pelosi announced herself “particularly concerned” that the highest price of gasoline recently was in her San Francisco district — $3.49. So she endorses HR 1252 to protect consumers from “price gouging,” defined, not altogether helpfully, by a blizzard of adjectives and adverbs. Gouging occurs when gasoline prices are “unconscionably” excessive, or sellers raise prices “unreasonably” by taking “unfair” advantage of “unusual” market conditions, or when the price charged represents a “gross” disparity from the price of crude oil, or when the amount charged “grossly” exceeds the price at which gasoline is obtainable in the same area. The bill does not explain how a gouger can gouge when his product is obtainable more cheaply nearby. Actually, Pelosi’s constituents are being gouged by people like Pelosi — by government. While oil companies make about 13 cents on a gallon of gasoline, the federal government makes 18.4 cents (the federal tax) and California’s various governments make 40.2 cents (the nation’s third-highest gasoline tax). Pelosi’s San Francisco collects a local sales tax of 8.5 percent — higher than the state’s average for local sales taxes.

The absence of an entire quotation ought to be a sign to the kids out there that a straw man is in the works. Why not just tell us what the law says in its own words–like snot-nosed internet critics do for you? Here’s an example:

>B) indicates the seller is taking unfair advantage unusual market conditions (whether real or perceived) or the circumstances of an emergency to increase prices unreasonably.

That seems far less unreasonable than the selective quotes. He doesn’t even link to the text of the bill. If he had, he could make a stronger case for his position. But having distorted the purpose and content of the bill, Will now grasps even further: but the government gouges too! Jeez. That’s not even close. If you don’t know what “gouges” means, look it up in the dictionary.

At long last, a response

Not often does one see columnists argue openly with each other–especially columnists of the same newspaper. The best they can usually muster is the straw man “some say . . “. That’s why it’s refreshing to read the following from Sebastian Mallaby of the Washington Post:

>Some say the bank isn’t worth rescuing. My colleague George F. Will asserts that 90 percent of the bank’s loans go to 27 middle-income countries that can get all the development finance they need from private capital markets. But this statistic leaves out the bank’s soft-loan and grant-making arm, which serves countries with gross domestic products of less than $965 per capita. Counting that, just under half of the bank’s money went to poor countries in 2006. The middle-income countries that received the rest of the cash include such places as China and Brazil, which are home to millions of poor people.

>The bank’s critics ought to understand that while capital markets are marvelous things, they can’t be expected to do everything. Private investors won’t provide loans in the midst of a crisis, as the World Bank did during the East Asian meltdown a decade ago. Private investors tend not to finance global public goods — projects that are important for the world but not a priority for any one country. The world needs to curb carbon emissions, for example, but an individual country won’t capture all the benefits of a clean coal plant, since these benefits are shared globally. Because of this “externality” problem, there is a role for the World Bank in subsidizing anti-carbon policies.

We were struck by that same op-ed (for a different reason). Notice two things. Mallaby names his opponent specifically and he provides a link to the original argument (rather than a partial contextless quotation (so often the hoist by your own petard strategy employed by Will) or an unfriendly synopsis). If you have a question about Mallaby’s fairness (which you might) he tells you where to look. It’s almost as if Mallaby were some kind of media critic blogger. Now one can hardly expect the op-ed page to turn into the debate page. But a little awareness of each other seems to be a step in the direction of actual intellectual engagement.

A la mode

One fun and snobby way of undermining the sincerity, originality, and appropriateness of someone else’s moral claim is to call it “fashionable.” Perhaps not surprisingly philosophers do this to each other all of the time. “Oh that’s really hot right now” is another way of suggesting that someone is a follower rather than an original thinker.

With that broad theme in mind, let’s turn to today’s lesson from George Will. The World Bank scandal–in which Paul Wolfowitz, patient listener and student of foreign languages used his leadership role to score a lucrative job for his girlfriend–teaches us not about the incompetence, arrogance and corruption of its president, but it informs us about the decades long retreat from “statism” and of the absurdities of fettering capitalism. In the course of making this argument (which someone else can bother with), Will points to the superficiality of the World Bank’s causes:

>Much of what recipient countries save by receiving the bank’s subsidized loans they pay in the costs of ” technical assistance,” the euphemism for being required to adopt the social agendas of the rich nations’ governments that fund the bank. Those agendas focus on intrusive government actions on behalf of fashionable causes — the empowerment of women, labor, environmentalism, indigenous peoples, etc.

Take that girls, workers and environment. When will misogyny, slavery, pollution, and imperialism come back in style? Those were the days.

Little things

Earlier this week Paul Krugman wrote about the rhetorical effectiveness of spreading little falsehoods. These little lies, as he called them, get repeated over and over again first by the irresponsible media (Drudge, talk radio, Hannity, and so on), then they work their way up to Howard Kurtz and various other mainstream outlets, who take them or their authors seriously. It’s not of course only a right wing thing–just ask Bob Somerby or Glenn Greenwald. These little falsehoods take various forms. The most obvious is the malicious fabrication (e.g., recent inventions about Nancy Pelosi). Less obvious is the subtle or not so subtle distortion of views you don’t agree with. Those are the little lies George Will tells. Today, for instance, he returns to the theme of global warming (which he insists on calling climate change, despite the propangandistic origin of this phrase). The article is a Summa of all of Will’s recent climatic confusions, so it might take a while. So for today we’ll just comment on this:

>In a campaign without peacetime precedent, the media-entertainment-environmental complex is warning about global warming. Never, other than during the two world wars, has there been such a concerted effort by opinion-forming institutions to indoctrinate Americans, 83 percent of whom now call global warming a ” serious problem.” Indoctrination is supposed to be a predicate for action commensurate with professions of seriousness.

What are “opinion-forming institutions”? Are they the kind–like right wing talk radio or the Post editorial page–that endeavor to produce loud and sometimes false opinions about political questions? Or are they the ones (like universities) that produce what sometimes get called, true opinions with a logos–i.e., knowledge–about the world around us? Not all opinion-forming institutions, in other words, are the same; if so, parents can save a lot of money by sending their kids to Rush Limbaugh University. Aside from the sneering stupidity of the remark about the “entertainment-environmental complex” (this from a man, mind you, who takes a science-fiction novel (by a Hollywood producer) about global warming to be scientific evidence on par with the consensus of credentialed climatologists), we’d also wonder what “indoctrinate” (used twice here) means. One usually uses such terms in order to stress the value-laden character of the views being taught. Rarely would one use it to describe the process of informing someone of some other other fact about the world. Some call that “teaching.”

Three part invention

I can only be bothered to come up with three. There are many many more problems with this abysmal piece by George Will today. While it does make sense to adjust gas prices for inflation, the rest of his conclusions show a manifest ignorance about the nature of the energy problem and a reprehensible tendency to ridicule anyone who takes it seriously.

Here’s the first part:

>The next wave of stories about “soaring” gas prices will predictably trigger some politicians’ indignation about oil companies’ profits. The day after Exxon Mobil’s announcement that it earned $39.5 billion in 2006, Hillary Clinton said: “I want to take those profits, and I want to put them into a strategic energy fund that will begin to fund alternative smart energy, alternatives and technologies that will begin to actually move us toward the direction of independence.”

Here’s the second:

>Clinton’s “take” reveals her confiscatory itch. Her clunky “toward the direction of” suggests that she actually knows that independence is as chimerical a goal as Soviet grain production goals were.

The third:

>America produces about one-quarter of the 20.6 million barrels of oil it uses a day. Unfortunately, just as liberals love employees but not employers, they want energy independence but do not want to drill in the “pristine” (read: desolate) Arctic National Wildlife Refuge ( potential yield: 10.4 billion barrels) and are reluctant to countenance drilling offshore.

Equal rights

There’s a lot to complain about in this confused George Will op-ed. One could point out the limbaughesque caricature of “liberals”:

>Liberals, dolled up in love beads and bell-bottom trousers, have had another bright idea, one as fresh as other 1970s fads. Sens. Ted Kennedy and Barbara Boxer and Reps. Carolyn Maloney and Jerrold Nadler, high-octane liberals all, have asked Congress to improve the Constitution by adding the Women’s Equality Amendment, which, like the Equal Rights Amendment before it, says: “Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex.”

But I’d rather focus my attention on the following blaring confusion. Since Will can never be bothered to examine any of his opponents’ actual reasons for their views, he just makes them up. So he wonders why someone would need an equal rights amendment when the courts–you heard that right–found them to be a consequence of the 14th Amendment:

>March 1972 was a year after the Supreme Court cited the equal protection clause of the 14th Amendment when invalidating a law that involved discrimination on the basis of sex. And March 1972 was 10 months before the Supreme Court ruled in Roe v. Wade.

I’ve lost count of how many columns Will has written undermining that very principle of constitutional interpretation. And he finds the very principle of such litigation–i.e., the kind of litigation that clarifies the proper interpretation of the laws–odious:

>If Kennedy and like-minded legislators think that the condition of American women needs improvements, they should try to legislate them. Instead, they prefer to hope that liberal judges will regard the ERA’s language as a license to legislate. But, then, support for the amendment testifies to the supporters’ lack of confidence in their ability to persuade people to support such policies.

And someone might point out that a constitutional amendment is a form of legislation.
