It’s not only mistaken, it’s also wrong

John Kass, a columnist for the Chicago Tribune, argues in today's column that requiring health-insurance plans to include contraception for women in their health insurance plans is a "clear" violation of the First Amendment.  He offers this puzzling argument:

But then, recently, he decided to challenge the teachings of the Roman Catholic Church. And his new policy to force religious hospitals and schools to offer abortion-inducing drugs and birth control in health care plans for employees is a clear violation of religious freedom guaranteed by the U.S. Constitution.

It demonstrates to Americans that their government is not only willing but eager to dominate faith, by telling religions how to practice their beliefs. And if they refuse, then the faithful will feel the federal wrath.

So the president's policy is not only mistaken and insensitive and wrong, it is the perfect expression of everything Americans fear about the ever-increasing federal leviathan.

It is not only mistaken–it's also wrong.  Mistaken is the most wrong kind of wrong.  The article (and the comments) are worth reading for the factless cocoon in which some people seem to live.  Nowhere in the piece does Kass bother to (1) cite the facts about the actual policy; (2) consider reasonable objections to such non-restrictions; (3) discuss what the actual position of the Catholic Church is:

The Catholic bishops have called the new health coverage rule "an attack on religious freedom" and argue that all employers who object to contraception–not just faith-based organizations–should be exempt from having to provide it to their employees.

“That means removing the provision from the health care law altogether," said Anthony Picarello, general counsel for the USCCB, "not simply changing it for Catholic employers and their insurers."

He added, "If I quit this job and opened a Taco Bell, I'd be covered by the mandate."

That's not a slippery slope, that's their stated objective.  So imagine the following etiam tu quoque (offered, by the way, by a commenter on the Tribune page): the Chicago Tribune has now changed hands, it's owned by Jehovah's Witnesses.  However life saving blood transfusions may be, they are not covered on their plan because Jehovah's Witnesses do not believe in them.  Sorry John Kass, no blood transfusions for you so long as you work at the Tribune.  In addition, the JWs think it immoral to refer you to outside plans that would cover blood transfusions.  You must find insurance and pay for that out of pocket on your own.  A discount from you current plan to cover it would violate their beliefs (these are, by the way, objections actually offered to compromise plans by the Catholic Church).    Would you support the law then?

Anyway, the point is that it is not super-obvious to everyone that this is a religious freedom issue.  I would say that it's one worthy of some careful discussion.  Kass isn't offering that.

Arguers arguing

My sense is that critical thinking and informal logic classes stress the evaluation of arguments, not arguers.  This is fine as a starting point, but as a long run strategy, it ignores the fact that we have very often to evaluate arguers.  Someone who makes good ones, like someone who can throw good pitchers, is a good arguer; someone who makes bad ones, is a bad arguer.  It's a kind of skill.  The judgement about the person arguing strikes some, however, as having too much of an ad hominem character.  But ad hominems are not by their very nature fallacious.  They're fallacious only when the ad hominem judgement has no relevance to the truth or falsity or reliability or whatever of what a person is saying. 

In light of this, consider George Will's latest attack on his favorite hollow man, "progressivism."

In 2011, for the first time in 62 years, America was a net exporter of petroleum products. For the indefinite future, a specter is haunting progressivism, the specter of abundance. Because progressivism exists to justify a few people bossing around most people and because progressives believe that only government’s energy should flow unimpeded, they crave energy scarcities as an excuse for rationing — by them — that produces ever-more-minute government supervision of Americans’ behavior.

and then later:

An all-purpose rationale for rationing in its many permutations has been the progressives’ preferred apocalypse, the fear of climate change. But environmentalism as the thin end of an enormous wedge of regulation and redistribution is a spent force. How many Americans noticed that the latest United Nations climate change confabulation occurred in December in Durban, South Africa?

Let's put this another way.  A person who makes up phony opponents (hollow men) merely in order to knock down their imaginary arguments with demonstrable scientific falsehoods is a very sorry arguer.  That's an ad hominem.

Stop contradicting yourself

Yes, this is exactly what diversity means.  This reminds me of a classic George Will argument (with the same equivocation) against "Liberals."

Although liberals give lip service to "diversity," they often treat federalism as an annoying impediment to their drive for uniformity. Feingold, who is proud that Wisconsin is one of only four states that clearly require special elections of replacement senators in all circumstances, wants to impose Wisconsin's preference on the other 46. Yes, he acknowledges, they could each choose to pass laws like Wisconsin's, but doing this "state by state would be a long and difficult process." Pluralism is so tediously time-consuming.

Got them liberals there George!  Maybe, by way of satire, we could construct the following argument to make the same very immature point: If you favor diversity, you favor it all of the time, if you have diversity all of the time, then you have uniform diversity, so you have uniformity, so if you favor diversity, you favor uniformity.  I should add: stop contradicting yourself. 

 

Smack Down!

The Huffington Post, despite much promise, is a huge disappointment.  One reason is that the editors characterize any kind of discussion as a "battle" and any kind of response to  criticism as a "smack down" or "slap" or somesuchother expression. 

Now some have argued, wrongly I think (irony alert), that Philosophy is to blame for this adversarial culture of argument.  This is what critical thinking and logic courses teach, they allege, so it's no wonder we have this language of argument filled with metaphors of war and sports.  Scott Aikin has a discussion of that topic here

But I don't think that's really the case for Philosophy.  Speaking somewhat anecdotally, philosophers deploy critical analysis (including "the fallacy technique") to uncover the silliness of HuffPo style "debates."  Here's a good example from this morning's HuffPo.  It's an article which the front page calls "Barney Frank Smacks Down George Will."  The actual article, however, is actually appropriately titled "Barney Frank, George Will debate Pot Legalization".  This includes a video here.

I think this is actually a fun exchange.  Frank argues that self-regarding behavior of adults is their own business, Will plays the conservative end of the conservative side (not the libertarian end), arguing that the jury is still out on these things, and that "liberalism" is averse to facts.  Even if Frank had successfully dismantled the dishonest structure of Will's pseudo libertarianism, I wouldn't call this exchange a "smack down."  Come to think of it, I'm not even sure what a "smack down" is. 

Inner Witlessness

David Brooks has a problem with all you people and your outrage over the rape of young boys.  So take a break from feverishly trying assuage your liberal guilt with innumerable OMG SANDUSKEEZ A PERV OMG #librulzrule tweets and witness the real root of your outrage: your own vain refusal to acknowledge the capacity of human beings to deceive themselves about their willingness to act.

I know. A shocking thesis. Let's hear it again.

People are outraged over the rape of young boys because they are trying to mask their own guilt at knowing they would probably also do nothing.  Quoth Brooks:

First came the atrocity, then came the vanity. The atrocity is what Jerry Sandusky has been accused of doing at Penn State. The vanity is the outraged reaction of a zillion commentators over the past week, whose indignation is based on the assumption that if they had been in Joe Paterno’s shoes, or assistant coach Mike McQueary’s shoes, they would have behaved better. They would have taken action and stopped any sexual assaults.

Unfortunately, none of us can safely make that assumption. Over the course of history — during the Holocaust, the Rwandan genocide or the street beatings that happen in American neighborhoods — the same pattern has emerged. Many people do not intervene. Very often they see but they don’t see.

So, if people can't stop a genocide, they can't stop a rape.  That seems off to me, but who am I to say? After all, Dave has SCIENCE!

Even in cases where people consciously register some offense, they still often don’t intervene. In research done at Penn State [ed. note: site where study occurred chosen, like, totally at random] and published in 1999, students were asked if they would make a stink if someone made a sexist remark in their presence. Half said yes. When researchers arranged for that to happen, only 16 percent protested.

In another experiment at a different school, 68 percent of students insisted they would refuse to answer if they were asked offensive questions during a job interview. But none actually objected when asked questions like, “Do you think it is appropriate for women to wear bras to work?”

First, we're given no indication of (1) the source of these studies, (2) the size of the samples, or (3) whether or not they were published, and therefore subject to the rigors of peer review.  For all we know, this was some odd balding guy with wire-rimmed glasses and a bow tie and a New York Times press pass, wandering around Happy Valley and Different School University creeping out students with odd questions.  Second, of course self deception could be only explanation for the responses to these studies.  It couldn't be that college age individuals are often poorly educated as to what constitutes sexual harassment or inappropriate sexual behavior, or that the studies appear, at least on their face, engineered to elicit a specific response.  Nope. The only explanation is that people deceive themselves as to the extent they would act to stop another human being from being harmed. Why, you might ask? Dave has answers, bros:

In centuries past, people built moral systems that acknowledged this weakness. These systems emphasized our sinfulness. They reminded people of the evil within themselves. Life was seen as an inner struggle against the selfish forces inside. These vocabularies made people aware of how their weaknesses manifested themselves and how to exercise discipline over them. These systems gave people categories with which to process savagery and scripts to follow when they confronted it. They helped people make moral judgments and hold people responsible amidst our frailties.

But we’re not Puritans anymore. We live in a society oriented around our inner wonderfulness. So when something atrocious happens, people look for some artificial, outside force that must have caused it — like the culture of college football, or some other favorite bogey. People look for laws that can be changed so it never happens again.

Maybe I'm wrong, but I'm pretty sure that the tendencies noted in the second paragraph stem from an adherence to the codified moral systems whose absence from present day society is implied by the same paragraph! But perhaps I'm simply deceiving myself. After all, as someone who considers himself a vehement opponent of old men raping children, I'm obviously just pontificating from my perch high atop the moral high ground. Right, Dave?

Commentators ruthlessly vilify all involved from the island of their own innocence. Everyone gets to proudly ask: “How could they have let this happen?”

The proper question is: How can we ourselves overcome our natural tendency to evade and self-deceive. That was the proper question after Abu Ghraib, Madoff, the Wall Street follies and a thousand other scandals. But it’s a question this society has a hard time asking because the most seductive evasion is the one that leads us to deny the underside of our own nature.

Seems to me the proper question is how we can stop 55 year old football coaches from using the facilities of one of the most illustrious athletic programs in the nation to rape boys.  Seems to me the proper question is how we might rebuild the power structure at Penn State to ensure that the full powers of that institution of higher learning are never put in service of the protection of a child rapist.  Seems to me the proper question is why a judge that worked for the foundation this man used as his child rape pool, was allowed to hear this man's case and then set him free on unconditional bond.  If my thinking that these are the proper questions make me someone who is simply trying to assuage liberal guilt, then I prefer the deception to the alternative.

Which, on the basis of Brooks' claims, seems to be nothing.

With a rebel yell, they cried “Moore, Moore, Moore”

I happened across two related items on the Atlantic Wire, a blog of the Atlantic Monthly.  One reports that liberal filmmaker Michael Moore has a very nice vacation home on the shores of Torch Lake, near Traverse City, MI.  The other wonders whether George Will should disclose his political consultant wife's clients

The Moore item carries the water of ubertroll Andrew Breitbart, who alleges that Moore is a hypocrite for being rich and criticizing the rich:

No one begrudges Moore his wealth, but it is deceitful for him to claim poverty while encouraging class warfare among other Americans. It is also purely narcissistic and selfish for Moore to back radical and destructive socialist policies that would deny other Americans the opportunity to become as rich as he is.

Torch Lake is a nice lake, Michael Moore is a rich guy.  How rich?  It does not matter.  Has he made his money on Wall Street.  No.  Boo to the Atlantic for running this kind of intellectual garbage.

The other item on George Will is almost as dumb. 

But it does seem that in all his words written about the Republican field so far, and particularly in the broadside against Romney, there might have been room for Will to note that he's related to someone who is actively working with some of the very campaigns he covers. Then, this is an improvement over earlier election cycles, when Will played both sides of the journalistic line, all by himself

George Will is not a journalist.  He is a pundit, a professional arguer guy, he's paid to have opinions about stuff.  You can look through the archives here for what we think of his opinions (not much).   

Iron man versus straw man

Here is serial straw manner George F.Will on Elizabeth Warren, candidate for Senate in Massachussetts:

"There is nobody in this country who got rich on his own. Nobody. You built a factory out there — good for you. But I want to be clear. You moved your goods to market on the roads the rest of us paid for. You hired workers the rest of us paid to educate. You were safe in your factory because of police forces and fire forces that the rest of us paid for. . . . You built a factory and it turned into something terrific or a great idea — God bless, keep a big hunk of it. But part of the underlying social contract is you take a hunk of that and pay forward for the next kid who comes along.”

Warren is (as William F. Buckley described Harvard economist John Kenneth Galbraith) a pyromaniac in a field of straw men: She refutes propositions no one asserts. Everyone knows that all striving occurs in a social context, so all attainments are conditioned by their context. This does not, however, entail a collectivist political agenda.

Such an agenda’s premise is that individualism is a chimera, that any individual’s achievements should be considered entirely derivative from society, so the achievements need not be treated as belonging to the individual. Society is entitled to socialize — i.e., conscript — whatever portion it considers its share. It may, as an optional act of political grace, allow the individual the remainder of what is misleadingly called the individual’s possession.

In large part the straw man diagnosis is purely factual: does arguer A hold position p?  You merely have to go and check (um, editors?  fact checkers?).  Rarely does a serial straw manner such as Will make it so easy.  For Will's favorite straw man version is the hollow man–the variety of the straw man which attacks positions no arguer is alleged to hold.  Here we have Warren's actual words.  Sensisble or not (hey, I think they are and I've been making that argument for years, before it was cool), she is not asserting anything like what Will is saying.  

Worse than this, is the way Will poses the iron man–the egregiously charitable reading of his own team's view–next to the straw man of the other team.  Few in the Republican establishment seem to endorse that part about paying it forward via taxes, or that social infrastructure spending, education spending, etc., serves the purpose of individual striving.

Just is

Yet again, in the can't tell if trolling category, we have Ross Douthat, New York Times Columnist, arguing for the death penalty.  It's the not fact of arguing for it (full and irrelevant disclosure: I think we're better off without it), it's the way he does.  His argument has all of the earmarks of a sophistry challenge:

This is a healthy fear for a society to have. But there’s a danger here for advocates of criminal justice reform. After all, in a world without the death penalty, Davis probably wouldn’t have been retried or exonerated. His appeals would still have been denied, he would have spent the rest of his life in prison, and far fewer people would have known or cared about his fate.

Instead, he received a level of legal assistance, media attention and activist support that few convicts can ever hope for. And his case became an example of how the very finality of the death penalty can focus the public’s attention on issues that many Americans prefer to ignore: the overzealousness of cops and prosecutors, the limits of the appeals process and the ugly conditions faced by many of the more than two million Americans currently behind bars.

Simply throwing up our hands and eliminating executions entirely, by contrast, could prove to be a form of moral evasion — a way to console ourselves with the knowledge that no innocents are ever executed, even as more pervasive abuses go unchecked. We should want a judicial system that we can trust with matters of life and death, and that can stand up to the kind of public scrutiny that Davis’s case received. And gradually reforming the death penalty — imposing it in fewer situations and with more safeguards, which other defendants could benefit from as well — might do more than outright abolition to address the larger problems with crime and punishment in America.   

That Troy Davis's likely unjust (and therefore actually unjust) execution inspired people to care about his fate is not an argument in favor of the death penalty anymore than the outpouring of blood donation and patriotism was an argument for 9/11.  Some in the public responded in the appropriate moral way to an atrocity.  Good for them.  But the atrocity is not the reason for their being moral.  Take away that atrocity and they can be moral about something else–like prison reform, about which many already care death penalty aside–Douthat's insinuation is a false dichotomy (it's either death penalty elimination or broader prison reform!). 

There's too much that's just awful here to comment on.  Here, however, is the worst of the worst:

Abolishing capital punishment in a kind of despair over its fallibility would send a very different message. It would tell the public that our laws and courts and juries are fundamentally incapable of delivering what most Americans consider genuine justice. It could encourage a more cynical and utilitarian view of why police forces and prisons exist, and what moral standards we should hold them to. And while it would put an end to wrongful executions, it might well lead to more overall injustice.

And thus the sophistry challenge.  Eliminating the big injustices would merely (albeit justifiably) undermine confidence in the unjust system.  That would be unjust. 

Gospel of greed

According to Pat Buchanan, taxing investment at something north of half of the rate work is taxed is

rooted in the philosophy of envy and the gospel of greed.

Mr.Buffett says he is unhappy because he doesn't pay as high a tax rate as he says his secretary does.

I suppose he envies his secretary's high tax rate and is greedy for more tax payments.  Watch the clip, not even John McLaughlin can make any sense of this.  Asking Buchanan to explain how it is that Buffett's claim that it is unfair that he pays a lower tax rate on his investment than his secretary does on work might amount to greed or envy, Buchanan retorts:

I think he's a plutocrat who is playing to the crowd.

Plutocrats, always playing to the crowd by demanding higher taxes on themselves.  This has to be the worst ad hominem circumstantial in the history of the McLaughlin Group.

Unpatriotic

In what's good for the gander news, NRO's Jonah Goldberg thinks that President Obama's rhetoric has turned ugly.  He's using patriotism against Republicans. 

According to his new stump speech, if you oppose his agenda, then you don’t care about America as much as he does.

Well, let's see the line that Goldberg thinks crosses the line.

What is needed is action on the part of Congress, a willingness to put the partisan games aside and say we’re going to do what’s right for the country, not what we think is going to score some political points for the next election. . . . There is nothing that we’re facing that we can’t solve with some spirit of ‘America first.'

Goldberg objects that the 'America First' spirit is supposed to "separate the patriotic from the petty."  But surely this is mild compared to, say, Michele Bachmann saying liberals are unAmerican or even the rest of Goldberg's article, which makes hay about how the President is going on vacation (and so thereby must not be patriotic, either!).  

The point, however, isn't to make the hypocrisy charge here.  The point is to say that Goldberg doesn't defend those charged with pettiness.  He only cries foul at their being called petty.  But surely if there is a group of legislators that are out only to save their hides for the next election rather than making hard choices or getting on with the work of governing, then they need to be called out.  Moreover, it's not the charge of being unpatriotic that I saw in the Obama speech, but the charge of political cynicism.  And it's easy to be a political cynic and be really patriotic.  In fact, those all too often go hand in hand, don't they?
